Citibike has the records and can easily be subpeonaed. And she’s raised all she needs for legal expenses. Not that subpeonaing these records is an expensive task.

So is that admitting he was wrong? As someone who has never rented one of these bikes, I'm confused by the whole thing.

I was a poster who really believed she was in the wrong after watching the video. Her behavior did not seem to match anything I've seen from victims or experienced as a victim myself. Obviously I was wrong.


There weren't really any victims in this. There was a misunderstanding that led to a very minor confrontation as both parties felt they were in the right. She was tired and fed up and wanted to go home and some of that came out. The boys were being rude and she realized she just needed to let it go and get on a differnet bike and go home.

Her lawyer is very professional and not a drama / lime light / dramatizing type. He is an employment lawyer, not a celebrity lawyer. There is no reason to not believe her account (told via her lawyer).


The woman who was out umnered, harassed, and had her fetus threatened, and was humiliated on video on Intermet, who was stalked and scared away from her own home, and was sent away from her job, is certainly a victim. I hope she wins a huge payout. And social media sites need to pay for spreading this stuff recklessly.

Her defamation case is really, really good. Here’s the law:

The four elements of defamation are:

A defendant made an oral or written factual and defamatory statement;
Regarding the plaintiff;
That was published without privilege or authorization to others by the defendant; and
There was resultant injury, unless the statement falls within a category of “per se” harm.
In defamation per se cases, a plaintiff does not need to prove damages. The categories of defamation per se in New York are:

Charging a plaintiff with a serious crime;
Stating false facts that tend to injure a plaintiff in his or her business trade or profession;
Charging that a plaintiff has a loathsome disease;
Imputing that a plaintiff is unchaste.


There are two categories of per se damages I have seen: 1) accusing her of attempted theft (news outlets) 2) accusing her of treating patients improperly due to her racism (twitter activists).

This is why I was particularly astonished that so many outlets didn’t hesitate to state she had committed an attempted theft. That’s rookie league stuff.

It's s exaggerations like that which made people not believe her at first, because she seemed overly dramatic and entitled.

I hope she stays far away from the "threatening her fetus" claim, as I don't see that working in her favor at all -- especially after watching her odd performance in that video.

You’re clearly not on her side if you keep insisting a pregnant woman coming off a 12-hour shift, who has just had her bike physically shoved back into the dock while she was sitting on it, and who is surrounded by four guys heckling her and calling her fetus the r* word, isn’t allowed to cry or call for help.
