A president has to have immunity because if he doesn't he'll immediately get prosecuted by the opposing party as soon as he leaves office....

Uhhh - only if he's a criminal. Nobody's prosecuting Obama, because he isn't a criminal and there's nothing to prosecute him for e- unlike Trump, who has 91 indictments, already found guilty of sexual abuse, defamation and financial fraud...

The DC appeals court has affirmed Judge Chutkan’s decision that Trump does not have presidential immunity from prosecution in the January 6 charges.

I think the SCOTUS will allow this case to continue. There is no basis to hear it at that level and it may buy them the time on the Colorado case.

Spoke too soon. Mandate to issue on Monday unless Trump petitions SCOTUS to stay issuance of mandate.

IMO, this is how it will play out, or at least it's how Trump hopes it will play out

1. Trump will appeal to SCOTUS now
2. Lower court will stay the ruling until SCOTUS hears the case
3. SCOTUS will punt until after the election
4. Trump gets elected
5. SCOTUS indicates a sitting POTUS cannot be tried for this
