On top of that the business records law violates the New York constitution. It is not clear if Trump's lawyers made this argument, but the part about 'another crime' violates a provision of the state constitution that does not allow vague language like this. |
The prosecution knows that any possible conviction will be overturned on appeal. The judge knows that any possible conviction will be overturned on appeal. They don't care. They just want to get a conviction - it doesn't matter if it is overturned because any appeal will happen AFTER the election. Their goal is to get a conviction BEFORE the election so Biden can run on that. Hopefully, the jury is paying attention - especially the two attorneys who presumably know the law. It should be obvious to them that there was no law broken. |
It's still not clear what law was actually broken. How can a state election law misdemeanor regulate a Federal election? |
That is because no law was broken. |
No, that’s your right wing cult speak. Trump is specifically charged with falsifying business records. The AP: “DEFINITION: This is the criminal charge that’s being decided at Trump’s New York trial. He is charged with 34 counts of falsifying business records in the first degree. It is a felony punishable by up to four years in prison, though there is no guarantee Trump would be sentenced to any time if convicted. He has pleaded not guilty. Under New York law, a person is guilty of falsifying business records in the first degree when he makes or causes a false entry to be made in a company’s business records and does so with an intent to defraud, including intent to commit or hide another crime. EXAMPLE: Prosecutors allege Trump misrepresented payments to Cohen in Trump’s company records as legal fees when they were actually a reimbursement for the $130,000 that Cohen arranged to pay Daniels. The records at issue include general ledger entries, invoices and checks. Prosecutors argue Trump’s actions were a way of hiding the hush money scheme and concealing other crimes arising from it, including alleged election law violations. Trump denies the allegations. His lawyers have said the payments to Cohen were for legitimate legal expenses.” https://apnews.com/article/trump-hush-money-catch-kill-criminal-trial-8b59e858a81feea5700e7bfcc77f1c09 I know Republicans think that Trump is a god-king above the law, but he’s just a greasy con man. And you’re the mark. |
Interesting. Can you name the code section for the "another crime"? |
There are also state laws concerning elections. |
Why the prosecution don't name specifically those code section from state law that was broken? |
So Trump's lawyers didn't preserve this obviously winning argument? Guess Trump needs a crack lawyer like you on his legal team. |
| Stormy Daniels is about to be called in New York, who sought to sell her story on Trump and received payment for a NDA. It is not clear what she offers beyond salacious details to embarrass Trump. The NDA is not in dispute... |
Trump has not made any factual stipulations at all in this case, so they could dispute any aspect of it. Sorry that your hero's actions are so embarrassing to you. |
Your ignorance is not a defense. |

For anyone who is actually interested, here is the announcement including links to the charging document and statement of facts:

Where do you people get your news from that a simple charge is so confusing? Makes you wonder if they are confusing you on purpose.
He is charged with 34 counts of falsifying business records. This is a very straightforward and not at all unique charge. The proof is clear that he has falsified the records. The harder part to prove is the intent, and that is what they are trying to do at the trial (the actual falsifying is clear and not disputed for the most part). |
You think the Republicans on this thread are interested in the fact that there are laws and the prosecution thinks he broke several of them? They are not interested. They want to muddy the waters. Their god king can do no wrong. |
