DeSantis and FL moving to hammer Disney

So it would seem that what Florida is trying to do is not actually legal.

This is incorrect. The landowners of Reedy Creek are the residents and landowners of the Lake Buena Vista and Bay Lake communities. There are just under 100 residents in those two communities. They elect officials and a board of supervisors to oversee the coordination with the WDW corporation for management of the special district. WDW is essentially the property management company of the district.

Wait, do we not care about feelings again? This is really getting confusing. I thought we were banning CRT because it hurt people's feelings.

I just got back from Disneyland and it was *very* crowded.

What's going to happen now that the bill has been passed, in both houses and is heading to DeSantis to sign is that Disney's legion of lawyers and their giant bankroll will now file for an injunction to stay the dissolution of RCID while they file for the law to be overturned. They will then file that the law passed is a violation of their first amendment rights of free speech and from government infringing on their right to free speech. The SCOTUS has already ruled that corporations retain the rights of entities and so the corporation has the right to free speech without infringement from the government. DeSantis has said that this was retaliation for Disney's comments about the recent DSG law. And his words will come back to bite him in court.

In addition, there is a Florida statue that says that special districts like RCID cannot be dissolved without a majority of the residents or landowners of the district. In this case the residents and landowners are a group of about 100 residents who own property in the two cities within the RCID, Lake Buena Vista and Bay Lake. These communities elect local officials and a board of supervisors to coordinate with the Disney corporation to maintain the RCID. This statue will also be called into court for the injunction.

There is no way that the state will be able to enforce the new law for years to come. It's all political theater.

I don't think it will go down like that. Reedy Creek owes about a billion in muni debt. If it is disolved that becomes debt of Orange County/ Orange County does not want that or really want the headache of what it all is. There is a provision in the law that allows negotiation for a new district. Disney's lobbyists will work their magic and a new district will be created to keep everythging going largely as is. DeSantis gets his win -- Disney keeps its district. That is the likely outcome.

If it is only a law that a majority of residents have to approve -- that can be changed by this new law. No rights under the old law. I don't think there is a suit here. There is a behind the scenes negotiation.

Just as a reminder, the government in a functioning Constitutional democracy is not allowed to punish corporations for their exercise of free speech. And there are 2 types of free speech that Disney is being punished for - the LGTBQ content of their products AND their campaign contributions, which the Supreme Court has held are Constitutionally protected free speech.

This is what fascists do - they punish corporations which do not support "the state."

Is this what you want for our country, Republicans?

There’s a reason countries with authoritarian governments have a very low GDP per capita. No functional rule of law + no freedom of speech + no entrepreneurialism + rigged elections = extreme poverty.

As I said above, this (the muni debt) is the key to the whole thing and why Disney will come out with at least an ok deal for them. They hold the cards.

Wow Florida republicans just took on over a billion in debt.

It is not just sex, its also gender and gender identity and encouraging prepubescent children to undergo gender reassignment.

Exhibit A and B for what my dad always said - never underestimate the stupidity of the American voter. These people exist. An actual person (I think??) typed these two statements.

I can only speak for my daughter, but since this bill passed, it's open season on gay kids in the school she goes to (in Florida, just to be clear). When they announce Pride Club at her high school (not "little kids", HIGH SCHOOL), along with the other clubs, they are openly boo'ed. They are mocked on the regular in the, what, 21 days since this passed. The homophobes like those above are teaching their children to be hateful, and they're doing just that in droves right now. And it's only just beginning. You two posters must be gleeful reading this. Must be so proud of the hate you're teaching your kids.

The liberal media decided to rename this bill the "don't say gay bill". In doing so they are promoting homophobia.

The "parental rights in education" bill addresses what should be taught in school by teachers in the third grade and below.

Just read the bill and a lawyer.

It covers all grades.

quoting from an NPR article:

The bill, which some opponents have called "Don't Say Gay," was signed by DeSantis on Monday. It reads, "Classroom instruction by school personnel or third parties on sexual orientation or gender identity may not occur in kindergarten through grade 3 or in a manner that is not age-appropriate or developmentally appropriate for students in accordance with state standards."

In other words the "don't say gay" emphasis comes from the Dems.

No one is going to successfully sue because a HS teacher brought up homosexuality in school.

"successfully" -- that doesn't rule out people suing and therefore intimidating school districts. Disgusting.

And it's already happening. Look at the books removed by a Florida school district: https://twitter.com/DWUhlfelderLaw/status/1516899552426700804. There's books there with zero sexual content that are only there because the contain depictions of gay families (Everywhere Babies, for example). The "Don't Say Gay" bill is turning out to be exactly what people predicted it would be.

But according to the wording of the law, any books with straight families can be banned too.

Which is why this bill might not survive. It's unbelievably vague and up for way too much interpretation. The fact that as many people just on this thread don't understand - despite claiming to have read it - that this bill applies to all students and not just K-3 shows how sneaky it's trying to be. It's way too broad and unclear and could bankrupt schools to boot.

According to the U.S. Supreme Court in Connally v. General Construction Co. (1926), a law is unconstitutionally vague when people “of common intelligence must necessarily guess at its meaning.”
https://en.wikipedia.org/wiki/Vagueness_doctrine

Exactly. Put 100 people in a room and you'll get 100 different readings of this bill. "Age and developmentally appropriate???" Give me a break with that crap.

The posters on this thread are either of below average intelligence or pretending they are.

I don't think the people of Florida would have any problem explaining to you what their bill means.

You can see the text. It's been quoted extensively in this thread. The language is pretty plain, and very broad, and clearly would ban me, a woman, discussing the fact I have a husband, to 2nd grade students. It would ban me from reading them books like "Ramona and Her Mother" because that's gendering right there, and a depiction of a hetero couple.

Just read the bill.

"Classroom instruction by school personnel or third parties on sexual orientation or gender identity may not occur in kindergarten through grade 3 or in a manner that is not age appropriate or developmentally appropriate for students in accordance with state standards."

No it would ban you from saying you had a husband or a wife for that matter unless it was part of Classroom instruction. You may say everything you do is classroom instruction but a court would never read it that way. It would not ban books like you said unless it was part of classroom instructiuon. Hetro or 2 mommies is incidental to classroom instruction for most books. Frankly I do not think it bans very much other than directly having a discussion of orientation or gender identity.

Technically they gave the problem to Orange County but not until June 2023 when this law goes into effect.

Those are both democratic countries. The republicans will be very happy to saddle those countries with debt or gut them in any way they can.

LOL, I think it's cute that people in this thread DeSantis will "win" (whatever the hell that means) this against Disney. Really cute.

Disney is going to keep the LGBTQ support because it's good for the bottom line, and they will not lose that cash cow to please DS.

I was there last week btw, it's was bursting at the seams crowdwise.

And he forgets that Disney has studios that can produce top quality documentaries and advertisements. It won’t be long before Disney tells it’s side of the story to all of Florida. This action by DeSantis seems to be a knee jerk action and not well thought out. In five years he will be largely forgotten in politics.

Oh, I think in five years he may be president

How right you are!
