There's a huge difference between doing nothing- even after the assailant moved away- and keeping someone in a chokehold until they die. I think I would have voted to acquit Penny, too, but that was an exceptional case that still demonstrated that people who intervene in those situations will be afforded broad leeway. Without cases that demonstrate the extremes it might be hard to know where the line is. That Daniel Penny could do what he did and still be acquitted should give people a very high degree of confidence that it is safe to act in those situations in good faith. |

Well it was probably his daughter but when I was a kid I was sitting in front of a girl that looked like him and she pulled out some scissors and cut some of my hair off and laughed. The teacher pulled her aside but nothing was done. I think it's partly jealousy though. Beautiful girl on a train and the guy wants to hurt her. |
This isn't a public transit issue. It's absolutely an issue about how we don't have a way to deal with mental illness in a way that protects the public. It's so dismaying that his guy wasn't in an institution. |
He made a horrible mistake with grave mistakes. I don't think there was malicious intent, but I do think there strong reasons to think he should have understood the grave risks of his actions. Strong enough that the people had a right to adjudicate his guilt. If you're not capable of understanding why that case reflects the very edge of acceptable and appropriate behavior, then I really don't want you intervening in public. You're far more likely to do harm than good. That's how we ended up with Kent State, and what we're risking now with the National Guard and ICE. |

It is very difficult to have someone institutionalized, even if they are obviously mentally ill, because most states set a high legal threshold before involuntary treatment is allowed. Laws around how the legal system can treat the mentally ill are passed at the state level and can be changed by state legislatures. In the case of NC, it is a red state and its current state legislature is controlled by the GOP and is in a position to be able to change state laws around institutionalization if they wish. |
The biggest barrier to institutionalizing people is the constitution.
People who are judging the bystanders are aholes. I’m sure none of them understood what was happening for some time. It was a bizarre incident and when someone is hurt, you don’t automatically assume they’ve been stabbed in the neck. And you don’t look up on the train and think “this is weird, maybe someone got stabbed in the neck.” You might see blood, but have no idea where it’s coming from, is it even real? I’m sure it was very confusing. |
PP here. I agree with all you said except about public transit in Charlotte. They don't have enough security there checking for tickets and keeping watch for a crisis or crime event of any sort. They know it and are making changes. |
Did you see the video of what happened to this girl? Maybe its because I have a pretty neice about her age but it brought tears to my eyes. The way the poor girl knew there was nothing she could do and just put her face in her hands crying. And no one helped her. I’ve never voted Republican once in my life but anyone human should be appalled by this. This guy had been arrested 14 times. He shouldn’t have been on the street. |
