| I am the lone dissenter here. I expect that the equipment would be serviced and not fall apart when being used. OP's injury could have been worse. if I were the manager, i would be apologizing profusely and comp her something. this could have been prevented if the equipment was checked periodically. |
This. Follow-up on the incident report to make sure concrete action has been taken. Depending on their response I would probably leave the gym. But you are fine and so you should not expect a payday. |
| I’m actually going to disagree with most people here and I am not a very litigious person. That is messed up. I agree they are probably not liable for much but I would publicize it on yelp etc. and ask for free classes or something. |

Your post is a bit over dramatic.
You may actually be entitled to something. Liability waivers do not typically cover negligence on he part of the gym, which improperly maintained equipment may fall under. Is this a battle really worth fighting for an incident where you were not seriously injured? If you want compensation follow up with management and tell them way you expect. |
| They don’t owe you anything financially for pain and stuff if that is what you are asking. However I would make it clear how unhappy you are about the crappy bike maintenance and I would’ve clear that I expect all the bikes fixed and properly maintained or you will blast compamints all over Yelp, NextDoor, etc. |
OK, there's a lot to eye roll about here. A bruise that "really hurts", an apology "in an official way", "I feel like I'm drowning", "desperately needed to de-stress", etc etc. I hate to tell you, but they're not going to routinely replace bolts in those bikes. The cost/benefit ratio is too low for something like that. Yeah, they'll fix something if it's broken or update some software, but they're not going to perform preventative maintenance at the individual screw and bolt level. The engineers who work at the company who designed those bikes did material stress tests on all parts, and something like a bolt snapping is going to get chalked up in the "freak accident" category (unless this is a defect and happening on many bikes). They change bolts and screws on airplanes because when those fail, hundreds of people die. Also, they are in service for decades on end. That said, you definitely need to speak to a manager about it. I don't think they OWE you anything, but I think it would be the right thing to do for them to comp you a month or two as a gesture of good will. Every contract you sign for a gym will point out that there are dangers and they won't be liable for injuries. This is one of the dangers. |
| Wow, people are harsh on here. I'd be demanding at least a few months of comp membership AND blasting the company on all social media sites. In this case, considering there have been a number of broken bikes already out of commission, the gym likely was aware that bikes needed maintenance, so at the very least they were negligent in not following through on the inspection. Everyone quietly sucking it up over a "just a bruise" is how these companies get away with negligence. Why wouldn't they if there are no real consequences? |

Since you were injured on their faulty equipment that was poorly maintained, I think you would be able to make a case for reimbursement of medical bills. However, you don't have any medical bills because you weren't seriously injured.
From a PR standpoint, it would be smart of the gym to apologize and offer a goodwill comped month or free something. |

op here. To respond to the people who said I’m being too dramatic—have you ever been in a car accident where the damage was fairly minor but you were upset anyway because it’s scary when it happens ? That’s how it was. |

I agree with everyone else, OP. You're being a drama queen. My God, I thought the end of your OP was going to say you ended up having a stroke! Your description was so over the top. Basically, the pedal fell off and your foot went with it. Of course, you had to point out that the only reason you're not injured more seriously is because you're in great shape! How do you know? Maybe somebody else would've just had their foot hit the floor and laugh about it.
Talk to the manager, see what they offer but, wow, get over it! |
