You don't know if the consensual sex was on campus. If they kicked every sexually active kid out of HS few kids would go onto college.

Glad to see the police rather than the school handling the investigation. Rape is a crime and, to protect the rights of all involved, adjudication and punishment shouldn't be left to the discretion of private schools.
