Arrest records cannot be considered as a disqualifier to employement. And most employers do not even ask about misdemenaor convictions. At this point as you are applying you have no reason to bring this up because there is no conviction. If you are convicted after hire check your employee handbook as you may be required to notify your company.
There has been a whole slew of rules released by the DOL in the last year on how to handle convictions. Google and read up. I work in HR and you wouldn't believe the number of folks that have DUIs - people you would never guess. But at the end of the day our employees are not transportation workers so the conviction isn't relevant (again read the DOL rulings). |
| In va, you will not get an expungement if you are found or plead guilty, FYI. Va has a very strict statute on this. |
Arrests can't, but convictions can. And DUI itself to me is an indicator of 1) Potential subsistence abuse problem, and/or 2) poor judgement. In my arena, which requires a federal investigation, the DUI would make it harder to get work....because it makes it harder to be successfully adjudicated for the clearance. |
| You should try to plead to a lesser offense. Is your attorney experienced in the court your going to? Don't just walk in and plead guilty to the judge. Your attorney should talk with the prosecutor the day of trial to see if you can do community service and some education for yourself to get a lesser offense. My dh was charged with reckless and was able to plead to improper driving. What jurisdiction were you charged? |
| no biggie, since they've been clamping down on it employer's understand that it's not as hard to get convicted in the past. In the past you could always pleed out now it's mandatory so in the past it mean you did something really bad where as now it is basically 1 drink and automatic DWI. |

Not always. We recently hired a guy who was arrested on a DUI in April '11. Plead guilty in Oct '11. His license was suspended except for work. Spring '12 we put him in for a TS and it was granted in Nov 2012. Again the DOL has just recently cracked down on using convictions for resasons not to hire. They are really tying the hands of employers on why you can't hire folks. |

OP you've made a mistake. From this point forward you can ensure you never repeat it. But you need to forgive yourself. You are owning up to what you did. There will of course be folks that cannot see past this. But there will also be others that will see your remorse and not use one mistake to define your character, future behavior, and ability to be a productive employee. A resource that you might want to look into is the Vienna Women's Center. They offer a varierty of counseling services including employment counseling. Perhaps they could help you frame the situation with potential employers. |
