I doubt the attorney's time would be wasted in this case. |
Why are people such jerks. OP was injured, and the proximate cause may very well have been the property owner's negligence in allowing ice to persist on the sidewalk. There's nothing greedy about holding people accountable for creating and allowing a dangerous condition to persist. This is basic common law negligence. Shame on you for being a heartless, ill informed jerk. Typical DCUM know it all who couldn't pass a torts class. |
| Depends where this happened. Some places are soft on this and say things like "using reasonable care". Since the ground was mostly clear this could be reasonable care and it's just a "too bad for you." |
Going on vacation isn't an excuse for allowing a dangerous condition to exist on their property. And no one's life is getting ruined. This is melodramatic and false. Have you never heard of home owner's insurance? |
It is quite frankly not my fault that I fell. I was wearing appropriate shoes for the weather, walking at a normal pace for a normal purpose on a sidewalk, in an area that appeared clear & safe but was not. There is nothing that I could have done differently not to fall. If there were no ice, or if it had been salted or marked, I would not have fallen. |
Hahahahaa |
| I do not like people like you. |
You took photos right before you fell on a random patch of ice outside someone’s house? Interesting. How do you know this homeowner? |
Black ice is still visible, it’s just looks wet. If the homeowner should have known the conditions were right for re-freeze you should have also known that and taken been more careful. Sometimes things happen. |
It's really gross that you and others think the fact that any settlement would be covered by homeowner's insurance is relevant in any way. |
How was the owner to know there would be black ice? Yikes. If the sidewalk was cleared was it really the homeowner's negligence? I have a neighbor who has a pipe from their sump going to the sidewalk that always causes black ice (it is also now allowed). If I fell I would sue since them doing that was negligence, but I stay away from that area in winter just to be safe. Remember that case where the aunt sued her nephew for breaking her wrist during a hug a few years back? Yeah, she lost. It was about insurance too. Good luck proving negligence. |

They did their best to clear it, but sometimes a bit of water can melt and refreeze. It is not always avoidable.
The one thing you can be certain of is that if you involve lawyers, they will make a lot of money. Everyone else will on net be worse off. Don’t make the world a worse place. |
I’m sorry but Op is an idiot. There is ice in winter. Sometimes it’s slippery. There is zero indication that neighbors created dangerous conditions. It is also unreasonable to expect neighbors to shovel everyday, all day. Will OP sue for sunburns in summer if she’s outdoors too long? Sue for falling leaves that create allergies? Honestly, what an irresponsible jerk. She fell. It happens in winter. Maybe don’t go out walking on icy days? OP is why we have such terrible neighbors in this world |
| Talk to a lawyer, if you should sue it’s not like you’re going to write it anyway. Your ambulance chaser will battle their insurance company. I have no idea if you will win. A lawyer might know. |
