Suing for ice on sidewalk

Anonymous
Yes I would sue to recover for all those bills you had to pay. Maybe next time they will buy the $5 jug of ice melt and spend 2 minutes applying it to their sidewalk.

Probably half of the people discouraging from suing are biglaw litigators who spend their days trying to ensure that huge corporations escape liability for terrible conduct, or who file lawsuits on behalf of those huge corporations in borderline meritless cases. Oh the irony.

It’s not typical that people sue other individuals for this. When you hear of people being sued, it’s the insurance company of the injured person forcing the lawsuit to recoup some of the cost of the insurance payout.

Lol. You are stunningly bad at critical thinking.

I put salt down after I clear my sidewalk and plenty of times it dissipates so I go out again, but how many times am I to do it? I have neighbors who will pull their kids on sleds on my snowy yard and that snow then goes onto my sidewalk and turns to ice. I go out and clear it if I am home and see it, but you can't be home 24/7. It is also up to you to check your surroundings.

We have to go to work, school, etc, I can't sit around all day running out putting salt down on my cleared sidewalk as the snow around it melts and makes the sidewalk potentially icy.

Yes seems the reasonable care poster summed it the best.

This. Also, I thought people are responsible for removing snow, so it’s “walkable”, which it seems they did. Not sure residents are also responsible for black ice.

It so happens I do, bc we took a photos right before and I was with other people, so there were multiple witnesses.

You took photos right before you fell on a random patch of ice outside someone’s house? Interesting. How do you know this homeowner?

I do not know the homeowner. The photos (of the people I was with in front of the property) were for an unrelated purpose.

+1
Subrogation. Illegal in some states - unless you have Fed gov health insurance!

This is absolutely covered by homeowners' insurance, and you should be offered a decent settlement. Do it.

It's really gross that you and others think the fact that any settlement would be covered by homeowner's insurance is relevant in any way.

If course it is relevant. There is a huge difference between taking from a family's finances an taking from the insurance policy they pay for for this exact reason.

How could you not work? You could use voice dictation, etc. NO.

Why were you hanging out on their property?

The one thing you can be certain of is that if you involve lawyers, they will make a lot of money.

Everyone else will on net be worse off. Don’t make the world a worse place.

I think these cases are usually taken on contingency.

BC I only recently learned that I might be able to recover some of the losses. Someone asked me if I sued and it had not occurred to me.

My job requires use of both arms and hands. One arm was in a cast.

Not everyone can.
