Important correction to your title, PP. They didn’t say no more warrants; they said no judicial warrants. That means no warrant signed by a judge which is the gold standard. They would still need a warrant but it would be issued by ICE so would have lower standards presumably. |

If you go to the documentcloud version there's more detail and the memo. The official guidance says you can arrest with a 205 (administrative warrant) any place you can lawfully be, which means consent, stopping them on the road (there's verbiage about being trained and certified or something for stopping while driving), would also include emergency exceptions which they don't get into. It indicates that entering a home without consent constitutes a search and requires a search warrant, which ICE cannot issue, has to be issued by a judge (ie neutral party). It does say if the agent knew the home was the person's residence and could articulate how they knew the person was there they could use an arrest warrant--which is 1-200, NOT I-205. Lyons is claiming they can use the 205. The language of the two forms is different, and 200 also has a section where the agent attests that they have served it to the individual. One difference as well is that the 205 is specifically for removing the person from the US. 200 is for arrest for the purpose of removal proceedings. I want to see the powerpoint they use in training. |
