Is this against Health Department regulations?

Fast fast casual restaurant where employees spoon out the sides. Is it against Fairfax County Health Department regulations to fill the cup and then spoon all or part of it back into the big container they dished it from when they realize they dished out the wrong side? This is before they've handed it to me.

Compared to what goes on behind the scenes, that is nothing.

That doesn't sound wrong OP. Food is only in spoon, main canister and a new, clean smaller container. If they handed it to you and you breathed all over it or they lick the spoon, then yeah.

That's why I was asking, because I can see how it might be technically allowed. It still seems like poor optics and overkill to return half the side to the batch when they're the ones who filled the large instead of the small in the first place.

This combined with some other things I've seen them do makes me wonder how they are being trained.

That's why I was asking, because I can see how it might be technically allowed. It still seems like poor optics and overkill to return half the side to the batch when they're the ones who filled the large instead of the small in the first place.

This combined with some other things I've seen them do makes me wonder how they are being trained.

Throwing out half the dish because it was spooned from one container to another sounds extraordinarily wasteful and would increase costs for no reason.

Allergens are not implicated. OP described spooning from a large container, to an empty clean container, back into the large container.

I think it’s best that germaphobes not watch their food be prepared and that they not look up the regulations that dictate the maximum amount of rodent hair and feces that is allowed in our food.

+1 throwing out perfectly good food is wasteful. They’re not doing anything wrong.

They've done both.

I'm not a germaphobe. I still eat it, eat there, even let my kid reuse a kid that had hit the floor yesterday. I'm just used to seeing wrong orders go in the trash everywhere else.

I'm also frustrated this place can't get the order correct. Their music is too loud they can't hear. They also messed up a different take out order in 4 different ways last week.
