Need a good lawyer for nanny issue

Anonymous
I'm in Virginia and need to consult with an attorney ASAP regarding a situation with a former nanny.
I've filed a police report due to their decisions on the job and they are retaliating by claiming unpaid child support. Nightmare. Please help.

I meant to write OVERTIME...not child support.

Just withdraw the police report. The firing was enough. This is why I always invent an innocent reason when k fire someone for cause. People are crazy.

Did you properly pay them overtime? You should have it all documented so its not an issue.

You don’t need a good lawyer. You either did or did not pay overtime.

Settle swiftly if you didn’t or liked to text her at all hours or somehow created responsibilities past 8/day 40/wk

We need more details. "They are claiming"...to who? Did they file a claim in small claims court? Did they make a complaint with the employment board? What was your goal with the police report, a restraining order or to have them arrested? This is missing context.

If they truly have unpaid OT, what exactly is your argument? I suspect OP is the crazy one.

Hire an employment lawyer. Probably they will tell you to settle. How much is this former employee asking for? Probably cheaper to just pay.

You sound entitled and maybe out of touch.

Regardless get a lawyer.

In some places, wage theft has statutory damages in addition to whatever you should have paid. OP, just google employer side employment law and your town or county and get someone to help you write a settlement offer where you each drop your claims against the other and agree to not further contact or disparagement. You will be lucky if she accepts it...I would frankly offer her exactly what she will get in a wage and hour complaint. Also if you have a clearance you may need to disclose this even if it settles. If you are an attorney, it could affect your bar membership. If you are ever in a position to be on a board or nominated for a government position, it could be a dealbreaker. Nobody wants a Zoe Baird situation. You really screwed up

Why aren't you paying overtime? Employees deserve fair compensation.

The nanny will win. Just pay what you owe.

What is the police report supposed to do? Are you filing charges for something?
