Did you file Schedule H? This may be a much higher-risk situation for you than you think. $$$$$ |
Well, her argument is probably nanny is lying- in retaliation of OP’s lawsuit. |
If she hopes to win that's an open-shut case. You bring out time cards. We kept one for our nanny for tax purposes and it made life easy. If she doesn't have that, she'll never win so she definitely shouldn't hire a lawyer. All courts care about is can you prove things with documentation. |
Omg people stop telling her not to hire a lawyer. OP, try this: https://vsb.org/Site/Site/legal-help/vlrs.aspx |
If she can't prove her case she's going to lose a lot more money in lawyer fees than she might just settling. That's why people are saying it. Does she have the literal receipts? If not...what does she think she's proving? |
The nanny also has to bring evidence that she did indeed work overtime, what the overtime rate was agreed on, and that she wasn’t compensated. Bringing a lawsuit isn’t evidence anything happened or didn’t happen. Both parties would likely settle on something if neither can prove their case. |
Do you give her a paycheck that shows hours? If she has no proof she can go to jail as usual, make sure to blast her info on dc nannies facebook group some other vicitims may step forward |
If you didn't pay her for OT then you deserve what you get. If you paid with cash then you are a fool because you paid off the books as an f it's a big fine. |
Pay you scum OP |
Why aren't you paying overtime? Employees deserve fair compensation
PAY |
Like they are claiming to be working hours on days when they used my credit card for personal expenses in a different state. It's very crazy and yes, I do need a lawyer.
|
Proving work hours is easy now a days.
She lives in a different suburb? Why was her cell phone dinging from your house 12 hours a day? (No one is going to believe she was visiting you just for fun and not working, so you're f*****. By law, you will pay HER attorney fees.) |
Paying OT is the law. |
