ICE - Face Masks and Warrants

Genuine question. Not a lawyer..

I've read that LEOs are supposed to identify themselves, read miranda rights and have a warrant signed by a judge for arrests. However, it seems pretty common for ICE to wear masks, not identify themselves, have no warrants or warrants not signed by a judge and take away people. How come there are no lawsuits enforcing those rules? Personally, I think everyone should get due process and criminal illegals should be deported, but wondering why none of the democratic state governors or the variety of non-profits that purport to stand for people's rights have not sued thus far. At least get an injunction in state courts so they can't operate like that in a particular state.

I know several people that have supported coordinated DHS, CBP, and ICE missions across several presidential administrations.

ICE has always operated in unmarked cars until the flashing lights come on. They don’t wear uniforms all the time when on duty, but they didn’t wear masks either. Much like the FBI.

They have just never been exploited in their agency mission for political purposes until this administration started weaponizing agencies.

Thanks! In the past, I suspect this style of operation was accepted by the states and therefore not challenged. Now that it's not the case, why isn't it challenged? Aren't they not LEOs? Do their rights somehow supersede legal precedent on identification, due process and judicial process (warrants)?

For immigration, judicial warrants are not required, just an administrative warrant issued by ICE.

They do, for entering private residences, businesses or other non-Public areas.

First, there is no video I’ve seen circulated on social media or by the news media that supports the assertion that agents aren’t identifying themselves to the target of their enforcement action. The target is the only person that has the right to know who the arresting agent is. That identification has happened every time. People forget that there are 1,300,000+ undocumented migrants in the country that have already received their due process and have a final removal order. No one on this forum can corroborate whether the people in the videos they’ve seen do or don’t have a final removal order. Even if they don’t, but they are here illegally, they are still subject to an immigration enforcement action.

I've posted this before:

This spring in an oilfield city in ND, a jail inmate was told to get his belongings together because ICE was coming for him. When the ICE agent showed up, he was handed over to the agent.
Only thing. . . no uniform, ID or papers presented, which the jail was used to. And the ICE agent was actually a buddy of the guy who had managed to call him and who arrived before the real agent arrived, which is when they figured out their mistake.

There is a standard MOU for local law enforcement who actively agree to coordinate with ICE. https://themarkup.org/tools/2025/04/16/law-enforcement-ice-cooperation-tracker tracks every such agreement.
My local pd has their policy ops manual online. There's a state law banning any sanctuary ordinances by local jurisdictions, but i was happy to note that our PD does not mandate reporting to ICE (says "may"), and discourages detaining people on suspicion of civil immigration violations. We're a bluish city in a red state.

There most certainly are news reports of people detained who do NOT have removal orders. And to "get the numbers up" ICE has been told to grab anyone else who happens to be in the vicinity of someone they have targeted, including people showing up to their final green card or citizenship interview.

Thanks for the clarifications.. Are you with ICE, a LEO or a lawyer?

I've seen several videos where they just seem to show up and grab people. Based on what I've seen, I don't think words were exchanged at all to make the claim that identification has happened every time. Definitely not by name. Most of the videos I've seen go like this.. A bunch of masked individuals show up, ask for someone by name and grab them if they resist. No identification presented. No warrant presented. There are also instances where citizens have been picked up, not clear if in error..

Images on the ICE twitter account verify it. If you scroll through you will also see unmasked agents making arrests currently as well. Your social media algorithm only feeds you masked agents for a reason.

ICE agents weren’t wearing masks for Covid in 2023 and 2024.
