But Congress has the tariff power, not the president!

Anonymous
I'm three steps behind--Congress has the power of the purse. Only Congress can decide to impose tariffs--on goods, not entire countries! Where is Congress in this?
And now, to go three steps ahead: I think Trump's plan is to make our economy so weak, and our country so vulnerable to China and to Russia, who are recruiting fired federal employees, that Trump will declare martial law. He's already declared it on the southern border.
Please, help me stay sane.

Yes, Congress has the power of the purse. Impoundment is illegal and tariffs are the province of Congress, not the executive.

There's already one lawsuit, and it won't be long until there are others.

Congress gave the power to levy tariffs to the president. They could take it back, but so far they haven't.

Congress has all sorts of powers enumerated in the Constitution, but the current GOP leadership has simply ceded it to Trump. Go figure.

OP is totally correct.

“He won the election” has become the justification for all kinds of illegal and unconstitutional activity.

The law Trump is relying on doesn’t even have the word “tariff” in it.

I thought they had enough republicans who would vote to take it back? This is when everyone needs to contact their democratic reps and demand that they stop watching from the sidelines and do something

No, the law Trump is using has never been used to impose tariffs.

This is what Grok said:

Trump is primarily using the International Emergency Economic Powers Act (IEEPA) of 1977 to impose tariffs in his second term, declaring national emergencies over issues like fentanyl, illegal immigration, and trade deficits to justify duties such as 25% on Canada and Mexico and 10% on China and all imports. He also leverages Section 232 and Section 301 of existing trade laws, which delegate tariff authority from Congress for national security or unfair trade practices. While IEEPA’s use for tariffs is novel and controversial, potentially overstepping its intent, these actions rest on broad statutory powers, though they face legal challenges for possibly violating Congress’s constitutional tariff authority.

And to the extent Congress has delegated this power, it would be subject to the same restrictions as any other agency. And with the demise of Chevron, no deference need be given to Trump and his tariff "experts".

But other Presidents have declared national emergencies to support their political agendas?
