I will preface this with the fact I have no desire to see non-violent immigrants deported. I don’t want a witch hunt and the rhetoric of the incoming administration is horrible.

However, I then read something like this and I’m like what the heck are the local dems thinking?

He’s currently awaiting rape charges and the Fairfax BOS is still not wanting to cooperate with ICE (despite the fact he could have already been deported before he committed many of these offenses). But this is exactly who we should all be agreeing should be deported. This sex offender adds nothing to our community and of course it’s often women who are the victims of these perps so I guess we are just like ehhh about indecent exposure and rape?

OP here. It does feel like insanity. And also the failure to truly enforce the laws we have. I am a total anti gun person and would love to see tough mandatory sentences for any crime involving a gun. You don’t get to plea to a misdemeanor if you brought a weapon to the commission of a crime.

But we don’t enforce this! And then we say we need more gun laws (which I 100% agree we do) … but they are useless if we don’t enforce them. Guns are a top killer in the U.S. (including kids!) so what rationale do we have to start giving second chances to people unlawfully using a gun? Nope, bye, we don’t need you in society for a good 20 years.

But we are then releasing him where he … goes out and commits more crimes. 🤨 I’d rather take our chances on sending him back to Honduras than repeatedly back out on the streets of Fairfax County. And if the feds know and haven’t gotten rid of them, then they’re at fault in this too.

ICE is notified by the Fairfax Police Department every time an undocumented immigrant is taken into custody. The next step is up to them - secure a warrant that would give judicial authority to detain.

I will respond pretending you actually want to understand. I have a few family member who worked in MCPD in major crimes and this was their experience.

He raped someone so they don't want to give him to ICE, he will be deported and he will come back and rape again.

Once ICE deported someone for something minor and he was a witness to a murder case but ICE didn't care.

You can't hold a rapist in jail because you can't treat a hispanic person differently and white people don't want their rapist son sitting in jail.

When someone is arrested, they go to jail and constitutional law determines how long you can hold a person not state or local laws. Fairfax wants a 48 hour notice to release but (for example) a DWI's is rarely even held 48 hours. What you would have to agree to is that your white 22 year old dumb ars son or white idiot H coming home from happy hour or your idiot white chick coming home from a vineyard who drank and drove will sit in jail for a minimum of 48 hours for DWI as a practice because you can't just make laws for hispanics. This doesn't even go to court you go before someone without even a law degree and they release you that night.

If a judge releases someone from jail, they are released, there is no 48 hour hold.

During Obama's administration, he gave a ton of money to increase ICE's presence in Montgomery county. They had a desk at major crime and could find out in an instant if someone was being released. They could be at the jail in 20 minutes and deport them. After Obama, the funds were cut, no ICE person was assigned specifically to MOCO so when a prisoner is released, the ICE person was told immediately, but they were busy and they got there after the person was released.

This is not a county issue this is an ICE issue. They need to be prepared to deport at a moment's notice and they can't have 48 hours to respond.

If someone really cared, like Obama, they could put money and ICE where their mouth is.
