Yes, Fairfax County has no Constitutional obligation to cooperate with ICE under the 10th Amendment. However, by failing to cooperate with ICE we can still blame Fairfax County for failing to protect its residents from criminal aliens that would otherwise have been deported.

I’ve said this before in this post. Fairfax tells ICE every time an illegal immigrant is detained for a crime. The next step is up to ICE. If they don’t have the manpower or funds to get a Judicial Warrant and come and pick them up, that is the Federal Government’s shortfall.
