Yes, the Supreme Court will make a decision. But in order to eliminate affirmative action they're going to have to effectively admit that they believe it was discriminatory all along, which will be tantamount to saying they believe that all aspects of the Civil Rights Act were immediately accepted and applied by everyone across the entire country as soon as it was passed and that it was not necessary to ensure that opportunities were mandated. Anyone with even a tiny bit of knowledge of US history knows definitively that that's not true. Thus, if SCOTUS reverses affirmative action, they're admitting that it's a political decision rather than a legal one. Or that they're stupid, which I don't believe. |

This is not a legal argument, nor is it even close to correct. SCOTUS has already addressed affirmative action in 1978, Regents v. Bakke, and concluded that AA in college is for diversity’s sake not to right the wrongs of segregation. “…the only justification for affirmative action was the educational benefits of having a diverse student body.” Race, Justice Powell opined, could only be used in coordination with other factors for the purposes of diversity.
