Listen, every company I have worked for says ‘we don’t factor race into our hiring decisions’ and then proceeds to take a race into the hiring decision.
I think diversity is hugely important to the success of a company. I want my team to look like the people they serve and add different perspectives. But if this is going to make it more difficult, I’m actually disappointed |

The 14th Amendment doesn’t apply to hiring by private companies. So these rulings have no impact.
SCOTUS could, in theory, overturn precedent and hold that affirmative action in hiring violates Title VII. But that’s for another day. In any event, no matter what SCOTUS does, proving discrimination in hiring is much more difficult because there are no test scores that employers use to compare applicants (except in certain fields). The evidence behind today’s decisions simply won’t be available should hiring practices come under scrutiny. |

NP. Sometimes. Dress, hair style, etc., can provide clues of a person's religious or political beliefs. There's also a sizable percentage of minorities who pass for Caucasian. |

Making a hiring decision based on candidate's race: illegal Pubic or private, Equal Opportunity Employment law applies. Make a decision based on relevant life experience, which might be inlacted by race: OK Make a decision based on ability to perform the job: OK If you have X demographic customers, then experience and knowledge of that demographic is a qualification for that job. If the job is to look like a person who looks a certain way in real life (actors): OK *recruiting* top of the funnel to counterbalance biases in your past recruiting: OK. Training your ass on how to not be racist: OK. |
