New car isn't driveable, but can't be fixed

Anonymous
We bought a car from Nissan last year. A part broke, making it not safely drivable for 4 people, so we can't fully use the car (we are a family of 4). The part they need to fix the car is on back order with no known date for when they would receive it. What are our options?

The mileage is over the lemon law limit, but we can't safely, fully use the car. Plus, they charged us about $1000 to fix the car, which did not fix it. What are our options? We took it to another dealership to evaluate it as well and they reached the same conclusion -- that we need this part that is not available.

They need to give you a rental until the part is available. This happened to my parents and they had the rental for a year!

What is the issue? Is it drivable, but like a seatbelt is missing so only 3 people can sit on it?

The passenger side airbag doesn't work.

They should be providing a rental for a 1 year old car covered by warranty.

Wow! I was just thinking that we may want to investigate that. Thanks for sharing.

Did you buy it brand new? They need to give you a loaner.

They are saying that the repair is not covered by warranty and that the problem is our fault. We had to pay out of pocket for the "repair" that did not fix the problem.

Yes, it was a new car.

This makes no sense. How many miles does it have? Why did you have to pay $1000?

They said that because there were some items under the passenger seat that they some how damaged the airbag sensors when the seat moved. I agree -- we're just trying to figure out the best way forward. Our extended warranty refused to cover it, too, which is why we paid $1,000.

The best way forward is to figure out when the part will come and then either wait for that +/- a rental paid for by someone else, though tbh I don’t see why they should. Your actions damaged the car. Why should the dealership pay for it?

You posted before. You should not pay. Call the manufacturer and demand they pay for a rental till fixed.

There is no law that passenger seats require airbags. As long as the airbag is disabled then move the passenger seat all the way back. Why can’t you drive it like that?

I heard this before on dcum. Did you post already? You don’t need airbags. Why can’t 3 people sit in the back? Especially if 2 of them are kids?
