Camp Rim Rock for sale?

My daughter worked there summer 2020. Many of the camp counselors worked all summer and DID NOT GET PAID. Lots of promises ftom owner, but still no money. How’d you like to work all summer (wearing a mask in the heat) only to return to college without the funds you worked your aaa off for?

I was leery about signing my daughter up this year (2021) based on the reports and situation but we ended up making the decision to have her attend a two week session. Everything was very organized on drop off day and based on the pictures and letters they are having a great time this summer. I wish there was more transparency and communication from the owner but the campers don’t seem to be affected and are having a great summer.

I think they are damned if they do, damned if they don't on communication. As long as the girls have a great time and everyone is paid for this year's work and last year's issues, that is the biggest and greatest thing that can happen.

DD attended riding week and session 1 this summer. From her perspective camp was great and it was a fabulous experience for her. She would definitely tell us if she had been miserable and if there were problems w the way things were running. I'm glad she was able to go this summer. We're rooting for a successful summer for Joe and the staff. I'm hopeful they can reorganize and re-build.

Anyone know what the chance is for parents who filed BK claims to be paid? Or should we just not count on receiving that money?

My DD did two weeks and wished she’d stayed for four. Was pleasantly surprised at how many of previous years friends also returned. She definitely noticed some changes and staffing seemed tight (still none of the counselors from Europe but that’s not a RR-camp specific issue.) She absolutely wants to go back next year so hope camp stays.

I am a new poster - we are still owed thousands of dollars that we prepaid in 2019 for 2020 and rolled over to 2021. We filed the claim. What happens next?

I'm glad kids had fun this summer, but many of us are still owed a lot of money (including staff it seems, from this thread) and no matter what the process is, that is just not OK.

I received a letter today that a motion to “Dismiss the Case or Convert to Chapter 7” has been filed in the Rim Rock bankruptcy case. Yeah I’m still owed money from the 2020 summer session…honestly I would have been fine rolling it over to another summer tuition if they’d just been *honest* about the state of things. It’s the shady behavior that makes me so mad - promising a refund, promising a refund again but later than expected, and then bam, filing bankruptcy, sorry no refunds. I don’t understand this new letter but it sounds like they just want to file a motion with the court saying Naw…we still don’t want to pay anyone what their owed.

Anyone else get this letter?

I also got the letter and don't understand my obligation. It's a motion to dismiss OR convert to chapter 7. How do we know which one? Did anyone get a copy of the Motion? It says you'll get one if you are on the Clerk's Service List and you request a copy form the attorney.

I don’t practice in the bankruptcy field, but I have a friend who has some experience with it. I wrote to her “In Ch 11 bankruptcy proceedings, what does it mean when the Trustee has filed a motion to dismiss the case or convert to Ch 7? I understand the conversion to Ch 7 piece but not the motion to dismiss the case piece. How can it be one or the other? Seems like a big disconnect.”

She replied:

“Conversion means the intent is liquidation rather than reorganization. Control passes to chapter 7 trustee whose responsibility is to gather assets and then distribute them pro rata to creditors. If the trustee is moving to dismiss the case all together, then that means that the debtor was a bad boy, and if the case is dismissed then creditors can proceed against the debtor because the stay is lifted. It could be that the trustee is making a move against the debtor, because the debtor is not doing chapter 11 in good faith. It sounds like a tactic to force a resolution, and to let the judge select whether to kick the debtor out of bankruptcy all together or to convert it to chapter 7. Sounds like the trustee is onto him. Neither solution is particularly for you, because it means either suing the owner along with everyone else, or getting pennies on the dollar in chapter 7.”

I am a parent that placed a deposit for 2020 summer camp, asked for a refund from Joe, and eventually filed a proof of claim for the camp’s Ch. 11. Thank you so much for sharing your friend’s reply. It seems like this motion is not a good sign and that we are unlikely to recover much of what we are owed. My question at this point is do we need to do anything to stay a claimant if this becomes a Chapter 7? Also, if this is dismissed, then we get nothing, correct?

My next question is whether Joe will be forced to sell the camp. If that is the case, the new owners hopefully will maintain it as Camp Rim Rock and continue the tradition.
