It's awful for an adult to go through all that girl had already experienced and what's waiting for her, for a child - I can't even imagine, poor little thing.

Just heard on channel 7 that there were incriminating text messages/pictures from the girl to one of the perps. Indicated she was agreeable. Kind of doubt she was agreeable to two guys though.......disgusting and sad at the same time. From what I have read, the gangs pull the girls in, as well. Isn't that what happened to the poor child who was murdered in Springfield?

Glad bond was denied. I would think they would consider these two flight risks.
And, this is a very serious charge.

Defense will make her seem like a whore.

Prosecutors will make him seem like a gang banger.

Lawyers are lovely like that.

Juries are not intelligent enough to go off pure facts they always want to know the back story, which should not matter.

There was just a segment on this case on Fox.

I still think these two are going to end up with a plea deal.
Sounds like there is ample evidence.


The State’s Attorney’s Office also has “communications between the two boys from the day before,” in which they plan the attack, she said.

Montano and Sanchez Milian discussed where it would take place and how, and whether or not to use condoms, Herdman said. Herdman alleges that they agreed Montano would get her to take her clothes off, and then Sanchez Milian would come in and threaten to tell a teacher in order to get her to agree to perform sex acts.

“This was clearly a conspiracy between this defendant and the other defendant to get her into that bathroom and rape her,” Herdman said.

The defendant's attorneys are claiming that they have photos and texts indicating the victim was "amenable". Is it possible that they are lying? I can't imagine that this is true considering the brutal nature of what happened.

It shouldn't matter what she sent them via text. If she said no it's rape

In the article linked above:

Wooten and Maria Mena, both representing Montano, argued in court Thursday that the girl texted Montano the night before the incident saying she agreeed to have sex with him the next day at school. They argued that her failure to report that text conversation and information about her previous sexual contact with Montano to a police detective in an initial conversation calls her reliability into question.

“The dynamics of the case have changed,” Mena said. The girl and Montano also exchanged photos and video in which they discussed meeting the next day, according to Montano's attorneys.

Prosecutor Mary Herdman argued that regardless of any previous consent the girl may have given to Montano, the act was not consensual and that the defendant and Sanchez Milian appeared to conspire together to commit the assault.


In another article I read, the judge indicated that the girl had a right to change her mind and that she never agreed (in the text) to sex with two people - nor did she agree to the different “acts” committed.

It doesn't matter what she said or sent them.

If she said No (implied by the screaming and grabbing onto the sink to avoid getting dragged into the stall) at the time, it is rape.

The defense attorneys want to make the victim out to be something she's not and attack her character.

And please keep in mind that the victim is only 14.

I agree that the texts don't mean it wasn't rape. If she didn't want it then it was a criminal act. BUT, I think that if she really did agree to go beforehand and she went in the bathroom with them willingly, it means people should not be blaming the school's lax security. Are security guards supposed to peek into stalls all day to see what's going on?

I really don't know. But the whole thing makes me want to flee montgomery county.
