They delay as long as legally possible.

But if the Supreme Court declines to hear an appeal about a case they won, they have their PR team jump right on it.

As far as I can tell, all the emails so far have referenced an overdose that was reported the day before or that day

Interesting side note about the 2 versions of the language in the emails.

Some have:

I am writing to make you aware of a non-fatal overdose after hours and in the community that was reported yesterday by Fairfax County Police involving a student from Marshall High School.

Some have:

In accordance with the Governor’s Executive Order 28 that requires a divisionwide notification for all school-connected overdoses, regardless of the substance, we are writing to make you aware of a non-fatal overdose that was reported by Fairfax County Police today at Whitman Middle School.

There are a few other versions as well. Keep in mind that the overdose can occur anywhere in the community: school, home, street, public library etc. If a police report is filed, and the child is identified as "attending a PUBLIC SCHOOL in Virginia", the Superintendent of that school system.
