AZ now bans abortion based on dormant 160-year old law

Nevada is very pro-choice. They have a Republican governor but the legislature is majority Democratic (and majority women!) plus they passed a state referendum years ago.

I think they’ll go with the “babies feel pain at 15 weeks” so we have to repeal AZ current law, which allows up to 15 weeks.

I can’t believe this is even happening at this point. Did they not just see Alabama flip a seat? How are these people so politically out of touch? Because they aren’t doing this on legal or moral grounds.

Can someone who knows the law better than me explain how an 1864 law has standing in Arizona? Arizona wasn't even a state until 1912. Arizona's Constitution dates to 1910. Arizona Territory was technically an entity separate from the state of Arizona, how is there still jurisdiction of Territory law? With this ruling, couldn't one then also argue that earlier Spanish Colonial laws are still in effect in Arizona, or that Navajo, Hopi or Apache laws predating Westerners are still in effect in Arizona?

And enough signatures have been gathered to get abortion access on the ballot this fall. I don't know how the GOP is going to fight that now...and I don't know how they plan to win at the polls. In theory (i.e. per the current polls), Trump is leading this battleground state. But yeah, that's not going to happen.

You know what is also painful? Giving birth. If "feels pain" is the standard that works both ways.

Kari Lake has campaigned on abortion bans and even banning the drugs that induce abortion.

Sure but MDs have to protect themselves and hospitals are going to want to consult with a lawyer first. Women will die. Women with other living children relying on them.

OBGYNs already have the most expensive malpractice insurance. It’s going to be hard to find a doctor for all pregnant women.

It was a Confederate Territory in 1864 FFS.
