I was referred to a family by a neighbor of mine.
The family needed a Nanny for only five days (one workweek) & I decided to help them out. Since it was only a five-day gig, I wasn’t put on any payroll. I would be paid via personal check at the end of my five days. This was their idea - they told me it would be easier for everyone if we went this route and I agreed. After working my five days > I was given a personal check for $650. The problem? They wrote the wrong year on the check. Instead of 2022, they wrote 2021 and since checks have a six month span, my bank (BofA) refused to cash it. I then contacted the family via text re: the issue + the Mother assured me she would pay me the amount in cash. That was ten days ago. She has not answered my texts or returned my telephone calls. I want to take her to Small Claims court, but since the money was technically paid “off-the-books” I have been told going to court would likely cause more headaches. How can I get what they owe me?? Thx. |
Just change the 1 to a 2, should be a very easy fix. Just make sure to use the same colored ink. |
Don’t worry about being paid off the books as you were an independent contractor but you have to declare it. Take them to court if you aren’t paid by Friday. |
Nannies can’t be independent contractors. She also doesn’t need to claim 1 week of work. |

No, no court. It's now worth. Just show up everytime and anytime at their house; without asking them. Try to be there after 5:00 pm or anytime on wknds. Asking that please you need your money. And that you can go along with them to ATM for your money. Or that you are not in a rush to wait for your money if they want to go to the bank without your. So you will be waiting for your money outside of their door or inside your car until they come back. |

File in small claims. Provide the documentation she put the wrong date and provide the check. |

Send an email that says "As you know, I am still wiating for my check for $650" that you promised me. You wrote me a check dated 2021 and told me on [date] you would write me a new check with an appropriate date on it. That has not happened yet. If I have not received a live check appropriately filled out by Friday, April 8th, you will leave me no choice but to take you to Small Claims Court to get the money I am owed, including all filing feels and costs. I look forward to us resolving this amicably. Thank you."

I would change the date on the check. Do her initials right next to the correction. I’ve done this on my checks with no issues. Back in the days when I still used checks. |
Actually before filing a claim in Small Claims Court, a claimant is REQUIRED to send out a letter via certified mail requesting what is owed to them. If the defendant does not respond back the claimant then can file a small claim. Well-written message PP. ![]() |
