We can't pay under the table for a variety of reasons. What is the most sensitive way to ask applicants on Care.com whether they have a work permit and are willing to have taxes deducted? I indicated this in our job description but still get applicants who wish to be paid under the table. I understand many are in difficult circumstances and wish I could help but I simply cannot do anything illegal.

Are you legally eligible to work in the US? This is a legally paying position that will require the nanny to complete an I-9 and W-4 while we set up payroll.

There is a box you check for check/transfer only on care.com.

State it clearly in all interviews and exchanges. It really isn’t a sensitive topic.

Why are you assuming your nanny candidates won’t be Americans?

Regardless, just state clearly that this is a legally paid position.

Go up in hourly wage. Do $25 to $30. That’s where all the legal-to-work and American nannies are. If you checked $15 to $20 on care.com, the legal nannies won’t even see your ad.

Our range is $18 to $25 depending on experience.

For the PP, I don't assume they won't or will be American; there are plenty of legal immigrants here. And i have received so many applications from people who then turn out to want to be paid under the table that I'm trying to figure out what I'm doing wrong.

Just put $25 an hour in the ad. You just don’t hire those with less experience or training. And state clearly in the ad that payment must be made legally (not in cash).

The care.com algorithm won’t let your job appear when nannies do a search for $25 to $30 an hour. You are getting the undocumented who will work for $18 in cash.

What is a work permit ? I don’t have that but I like to be paid legally. Ideally through a pay roll service with direct deposit.

First question during a phone interview:

“Due to [work requirements, security clearance, whatever] we must fill out the I-9 and pay legally with taxes withheld. Do you think that those conditions will work for you?”

That takes care of people not allowed to work and those unwilling to do taxes. The two groups overlap a bit, but they are not the same issues.

Many illegal nannies have tax ID numbers. They are still illegal though.

This it’s doesn’t care about their immigration status, they care if they pay taxes on earned income.
