The family I work for decided to not have me work, but also don’t want to pay me . My contract says guaranteed pay for 52 weeks
Both still work from home, so I’m a little disappointed they wouldn’t pay me any kind of money to support me I mean it will be weeks without pay, and that money could pay for my rent and food for months Unemployment money is not an option for me (don’t ask) So I’m not sure how to handle it They want me back whenever this is over, but I’m not making any money for at least 6-8 weeks |
Sounds like one or both of them is expecting to get laid off so they're trying to save money. |
Look for a new job and get paid legally next time. |
So look for a new job and make sure next time you can get unemployment. |
So sorry for your situation OP.
Perhaps you can find work in another area such as grocery stores. In my area these are hiring a ton. Walmart as well. Good luck! |
This. After you secure your next job, let them eventually find out for themselves that you aren't going back. |
Secure other employment and don't mention to this family. When it is time for you to return to work for them, simply don't show up. |
Just find another job, OP. Lots of families are hiring right now and desperate for help. Be safe - insist that all but the last interview be done by phone.
You have no legal recourse to recoup your lost wages since you’re working illegally. Your contract isn’t binding. Just be glad you found out how horrid these employers are and move on. Keep a happy face for your former employer to get a good recommendation but move on. |
OP here
Thank you all for your responses, I feel much better I realized it will be 7 weeks of lost pay by the end of April, that’s a lot of money I usually don’t leave families hanging like that, but they’re wealthy, still working from home, and not even offering to give me weekly money to pay food, I think that’s disgusting And still waiting for me to be there in a few weeks And what I’d it guess on for more weeks or will repeat in the fall? I can’t keep sitting at home with no pay Thank you all! Really makes me feel better about my decision to burn them! Stay safe everyone! |
If you’re eligible to work, and you have an enforceable contract, let them know that they can have you work or not, but you need to be paid. If they choose not to go at, you will need to look for another job. There are very few ways that you wouldn’t be eligible for unemployment. If you aren’t allowed to work, are already collecting government assistance (unemployment, disability, government pension, etc) or are wanted for questioning, yes I can definitely see why you don’t want to advertise what you’re doing. But if not? Go apply for unemployment. |
If you want the reference for later, make sure you let them know when and why. |
They terminated you. You owe them nothing. Look for a new job and let them know that you aren't coming back. |
I don't need to ssk because you were paid under the table. This does not preclude you from applying for unemployment, however. Filey your claim and an investigation will start. Next time, don't be a fool and next time get paid legally. Also, take current employer to small claims court. |
Correct Just because they were paying you under the table, doesn't mean you cannot apply for unemployment and get it They will have to back pay some nanny/employment taxes, but you will still get it |
But then she would have to pay income tax on her earnings. And she may not even be legal to work. |
