| I started a new job 3 weeks ago and they fired me today because I missed today for strep throat. I did miss one day last week because I was in a terrible car accident but still worked the same day. They paid me the first week. I work 3 days a week. They fired me for breach of contract ( missing days) and then said they will not be paying me my last paycheck. I told them by law I am entitled to all wages ( about $600 for 3 days of work) that I worked but they are refusing to pay me. Can I show up with a cop to collect my wages? |
| Anyone? |
|
I doubt a policeman can, or would, help you but Small Claims Court certainly can as well as local wage and labor office. I hope you are in DC as an employer must pay all wages owed within a specified time or there is a 10% fine for a maximum of ten days. I know because I took an employer to court in DC for my 10 fine days.
Also apply for unemployment. You have everything to gain and nothing to lose. Good luck. |
| You're not entitled to any pay if you're fired. |
what planet are you from???!!! Of course she's entitled to be paid for all of the days she's worked. Nutter. |
Not if you're terminated for cause. |
|
So sorry OP, but I don't think the police will be much help since this is a civil vs. criminal matter.
Best to go the small claims court route. Good luck! |
| Terminated for cause doesn't mean you aren't entitled to pay you've already earned. It can affect severance/notice period. |
| Small claims. Document everything |
| You can take them to small claims court and if you win your case you may be entitled to help from your sheriff's office (or whatever local law enforcement in your area handles court issues). |
Please, share with us where your law degree is from so we can laugh at this unaccredited law school. |
Haha seriously are that uneducated? You are entitled for every penny you have worked for. |
| You can call and ask but the police generally do not get involved with those matters. You will have to go to small claims court but filing fees and time may not make it worth your while. |
|
If you were paid legally you can file a claim with the labor department. They will contact your former employers on your behalf and they will be hit with serious fines if they do not pay.
An to answer your question, no, the police will not get involved in a civil matter...please don't even waste their time by asking. |
| You should go to small claims court or see a lawyer working pro bono to sue those people. Even if you are working under the table, you need to be paid since working without pay is a type of slavery and that's been illegal for years in this country. |
