Hi there! I nanny for a family who told me that I would have to take care of my own taxes when I started with them. They never had me fill out any paperwork and I had no idea that they wanted me to work 'under the table' because this is my first job in the US. And I just assumed that they meant that I will have to pay my taxes myself at tax time instead of them withholding for me.
Come tax time, I kept asking them for a W2 so that I could start filing but they kept brushing me off, when I kept asking they tried to convince me that I don't need a W2 but a 1099 and when I told them that I did indeed need a W2 they tried to tell me to not file ANY taxes at all! Or if anything, just a 1099 because that would be for my own good and I could save so much money and so on. They just tried pushing me into something I wasn't willing to do. They also told me that if they had to pay taxes now then they'd lower my pay. And they kept complaining how they had so many bills to pay and how they have no extra money like that ![]() When they finally realized that I was insisting on a W2 and I wouldn't have it any other way, they said they hired a payroll service and since it was so last minute and so much paperwork, they had to pay around $500. They showed me some receipt for that for just a quick second but I can not remember what exactly it said. Anyway, then they said that I could continue to work for them but I would have to split the cost for the payroll service. So they want me to give them about $250 for that. Are they right about this? They said they are because they assumed that I am working under the table and I assumed I was not. And had they known they would never have hired me because it was too costly.... What should I do? Pay the money or not? |
No, you do NOT pay them to employ you. That'd be very, very stupid. Get a new job. They're crooks and liars. |
NO! Call the payroll company asap to get your tax information, and get written verification that your employer is the reason you are filing late. Find a new job and quit. Inform the IRS after you quit about what the family tried to pull, including sending any documentation (emails, texts). |
Agree with 23:55's advice. All of it. And going forward, make sure being paid above board is in your contract. |

I did already file. They ended up giving me a w2 but said we have to split the cost for the payroll services they had to use because of me. Because I told them last minute that I wanted to have a W2.

Take them to small claims court to get your money back. What they did is illegal. Quit and report them to IRS. state tax office, ststevwage and labor office. They should be in jail! |
Your story is the reason employment laws exist. The government requires employers to take on the burden of legal employment. So they are required to pay the back taxes, and for the payroll service if they aren't capable of doing a simple W2 by themselves.
However, now that you know the deal with them, which is that they assumed you would be paid under the table, you need to quit and find legal employment. |

get a grip. They do not belong In jail over this. Good heavens. People go to jail for murder and child molestion, not for skipping out on a couple hundred bucks in taxes. Corporations get billion dollar tax breaks AND ship our jobs to abusive sweatshops overseas. Those are the real crooks and liars. |

Like I said, I have already done my taxes and he said that they did theirs as well. They DID back pay the taxes that they owed for me now. They said they hired a payroll service because it was way too much paperwork to handle since they never withheld any taxes until now. I was thinking that maybe it is kind of my fault too since I agreed to take care of my taxes on my own. It was a misunderstanding really... because they assumed that I was working under the table but I assumed that I was working legally but would just file my own taxes. When I told them that it was illegal if I did not file or if I did 1099 instead, they tried to convince me otherwise. That we could save lots of money if I either did not file at all, or if I did 1099 it would be for MY own good...when I said that the legal way is the right way because I will benefit from it they just said that they need to do what is best for them ![]() I am in the process of looking for another job but haven't had any luck so far. I can not afford to leave without having another job secured first. The ONLY reason I am considering paying them half the costs is because they might fire me if I do not. Or they might give me bad future references, which I absolutely can not afford because like I said, this is my first job here in this country and I REALLY need a (good) reference ![]() |
The ONLY deductions they can take from your paycheck are applicableb Federal, State, FICA deductions. Nothing else. Report these cretins! Also what they are doing creates a valid reason for you to quit and draw unemployment while you look for a new job. |
