Regulation change in VA RSS feed

Previously, regulations in VA only required that daycares be licensed if there were 6 or more children. Starting in July, any chidcare involving more than 4 children in which all children are not in the same family will require a license as a small family daycare. Did anyone else know about this? What is it going to change for nanny shares when both sets of parents want a second child?

Well, if the regulations state MORE THAN four children, and you're in a share where both families want a second child, then 2 +2 = 4, which is not more than 4.

I don't see the issue.

I would encourage you to fact check before posting.

First of all, the reason that this bill is being signed is because of the high number of deaths this past year (9 children under the age of 2!!) in daycare homes in VA that were unregulated.

Second of all, the requirement before was for home daycares caring for five children or more had to be licensed.

If a nanny share had two kids, one from each family, and both families decided to have another child, then it would still be legal. Five or more is the magic number in this case.

FACT: In Fairfax County, VA shares are flat out illegal without a license.

According to the state of Virginia, state licenses are currently required for 6+ children. Starting in July, state licenses will be required for 4+ children.

No idea about county level yet, I'm waiting on a call back. It seems like nobody knows exactly what the answer is without checking.

I called Fairfax Co. childcare licensing to specifically ask about a nanny share. They specifically said nanny shares are illegal in Fairfax Co.

You will see that the offices that give out the permits are located in Fairfax County. I can't find Fairfax's document similar to this, but the rules are the same for Falls Church City.

I wouldn't think parents would want to license. They don't want to deal with the inspections, regulations and paperwork. But maybe some don't mind it.

Right. If it's paid childcare, you have to get licensed for "in-home" childcare. Even if it's only one other child coming over.

Right. If it's paid childcare, you have to get licensed for "in-home" childcare. Even if it's only one other child coming over.


For 5 or more kids, you need a state license. For 4 or less, you need a county permit.

Most parents doing shares don't want to bother with the required child proofing.
