You only think about the vacation accrued. You say you started this year. If you started in Jan 1, you accrued almost 5 days and almost 2.5 sick days. But you spent 4 days. So you're talking about suing over 3.5 days. If you started later than Jan 1, it's even less days.

The subject line is misleading. OP took 3 sick days and gave notice to take another when she was fired. That's FOUR sick days in less than 6 months, assuming OP started on Jan 2.
