I would not have taken this job if my employers were sincere during the interview. I told them that I only work on the books, in an employer/employee relationship. She agreed and said she would look into it since the last nanny worked under the table. In the first or second week of work, she told me she talked to an accountant and would handle everything at the end of the year. Well, today she told me that they will not pay taxes and will not claim me as an employee. Her excuse is that they paid me for several days they cancelled. She basically told me that she shouldn't have to pay taxes since this is an easy job and they are nice to me. That's true, but it doesn't excuse their tax obligations. Their lack of integrity has lost them this nanny. What she meant was she would do things on the books as long as it didn't effect her. She admitted that to me. She just told me what I wanted to hear. Great for their child, who is now loosing his nanny in two weeks. I am one of the three people he sees on a daily basis. I will just enjoy the next two weeks with him now that I gave my notice.

| I would still file the time you worked for them as part of your taxes then the IRS can contact them over the lack of employer filing. Employers need to realize that household employees are just that - Employees. That means there is an employer/employee relationship that needs to be legal. |

I' m the op. I care for many reasons. First, I'm an honest person who follows the law. She told me at the interview that they would be using nannny camsbecause the last nanny stole from them. I would never steal from them, and I don't cheat on taxes. Also, I agreed to file as an independent contractor at my last gig. I didn't research it, and got burned because I didn't realize that disqualified me from receiving unemployment when the job was done. My current employer said she will give me a 1099 form (for independent contractors) and " you can do whatever you want with it." Since I only worked for them for seven months and its not a huge amount of money, I will just file as an independent contractor and give my two weeks notice. |
Um, I would absolutely NOT file as an independent contractor. File your taxes just as your normally would. Indicate your employer, and the total of the wages they paid you. There should be a place to indicate that you do not have a W2. There may be a special form to fill out, I'm not sure. Call the IRS and they should be able to point you in the right direction. Calculate your taxes. Submit with any payment due. Done. The IRS will take care of collecting the unpaid taxes from your employer. Seriously, OP, don't let them screw you over like this. They agreed to withhold taxes, and it is their responsibility to do so. |
| Also, since you are quitting because they are not paying taxes, you might actually qualify for unemployment. It doesn't matter that they haven't been paying unemployment taxes all along. That will resolve itself if you file and are approved. |
Why should she care? Let's see the risk is not primarily on them, as an employee (which a nanny is) she could get huge fines from the irs just as many if not more than the employer. Not paying taxes is like stealing from the government and is unfair to other nannies who follow the law. If you worked in an office would you still say why do you care? If you would your an idiot. If nannies want employers and the public in general to take this field professionally then we need to operate the same way "real" jobs work and pay taxes just like they do. I believe this is why so many people don't see nannies as professionals or that it's a real job and just babysitting (side note babysitting money should also be filed but that is rare). I don't care how nice a family is if they ask me to break the law then we are not a good fit Ignorance to the law doesn't make you not guilty. |

Nannies are NOT IC's and she's 1099'ing you to get out of paying her share of taxes. You will pay ALOT more if you pretend you're an Independent Contractor. Nannies are supposed to receive a W2. You're a household employee. You don't set your own rules, you work for THEM so therefore they are the Bosses. Don't let them screw you over by making you out to be a IC. |
Correct. You won't get into any trouble, especially since you only worked for them for 7 months, so you will still be able to file your return on time. |

Another lesson for next time -- sign a written contract with your employer. That you will be an employee and that the employer will handle taxes should be in the contract.
