When paying a nanny who is in the country legally but not legal to work do you pay cash? I've always done auto pay though our bank accounts in the past when everything was completely "above board." I'm not looking for opinions on whether to hire this nanny/pay under the table. This is a unique and temporary situation who anyone close to would understand. I'm just looking for advice (from those who have done this before) on the logistics.

| Have no paper trail. Cash only and don't withdraw the same amount every week from your account. Don't have any paperwork like a contract stating hours or wage. But understand it can still get tracked back to you if you're ever audited. |

| It doesn't matter how you pay her; it's illegal to hire her. Paying in cash may make it easier to hide what you're doing, but it's no guarantee. It can also be used as evidence that you knew what you were doing was illegal. |

All of us. Taxes pay for things we all use. Hiring someone not legal to work hurts the job market. There are lots of great nannies out there looking for jobs who are legal to work, why not hire one of them? This under the table stuff is what makes it so very hard to regulate this industry. If we all stopped hiring illegal workers, paying under the table, etc. you'd have less nannies being mistreated, being paid well below minimum wage, and cheated out of OT. The attitude that it doesn't hurt anyone is a dangerous one. The laws are there to prevent abuse and they should be taken seriously, whether you feel your situation warrants it or not. |
