Not only am I the PP who posted, I’m also a nanny. Most nannies won’t file if they have an agreement with their employer. However, employers should be aware that every (live-out) nanny COULD, even with a written agreement that there would be overtime. Also, live-in nannies in MD could too. |

OP, the law is clear that what you're describing would be considered work hours and therefore must be paid legally, at OT rates where applicable, subject to taxes and withholding, etc...
That said, this kind of time is often paid in cash, off the books. On the very rare occasion we have done this we have paid off the books, but at the OT rate. But we don't ask our nanny to do regular date night type babysitting, primarily because of the expense. It's also overkill in terms of staffing because on a date night the job mainly consists of sitting around the house while the kids sleep. And now - of course - there are no date nights so it's a moot issue for us. But I'm hoping to be in need of babysitters soon!!!!!! |
