EVERYONE I know in DC pays on the books due to federal background clearances, and every nanny I have hired expects it. New York, not so much. Most of the people in DC who can afford to hire a nanny are either current feds, might want to be a fed someday, or are attorneys. |
No. I'm married and already own a home. I prefer to be paid off the books. If I'm paid on the books it throws us into an even higher tax bracket than of we were not. Marriage penalty. No thanks. |

True. I'm the PP and work off the books. No shortage of people willing to pay me off the books. Feds or not. Btw...not everyone is a fed. They don't make the big bucks and are not often paying the $20/hr I ask. I've usually interviewed with private sector people (IT) and doctors. I'm very straight forward about my cash rate. I've had 2 long term employers only one a set of doctors the other set had corporate executive positions. |

I don't know how likely one is to be caught, but I have security clearance and believe it is always best to keep one's nose "clean." Penny wise, pound foolish. Murphy's Law. Etc.
Let's say you decide you don't need to mention your nanny's presence in the home, so as not to draw attention to your unethical tax-dodging. As a result of this, you don't know your nanny is a foreign national violating the terms of a visa, or undocumented. And maybe no one finds out. But if you are ... Do you want to know an investigator makes of an failure to report one's employment of a foreign national in the home? I don't. Consequences aside, the law is the law. I know a lot of people circumvent it. A lot of employers and nannies refer to go "off-the-books." But too bad: that's the law. If you are going to work in a career that involves that level of public trust then you, and people who want to work for you, are going to have to play by the rules. |

OP -- I don't understand. The vast majority of nannies in the DC area are paid on the books (in part because of the number of people federally employed); it's one of the things that drives up DC rates relative to other cities. Yes, it will likely come up in your security clearance. I work for State, just had my TS re-up and my investigator directly asked me what childcare I used... I assume so that he could check out this issue. You definitely need to pay SS/unemployment, but if you're nanny wants to fill out her income tax form as "exempt" so that you don't otherwise withhold, that's her business and you're not responsible if she's wrong/doesn't actually follow up and pay. |
