You are an absolute idiot for coming onto this forum and admitting to violating HIPPA laws. Are you nuts? What kind of person are you?

Your nanny was late because she said she had a medical problem, maybe she didn't feel comfortable telling you the truth. I hope she reads this forum and sees what kind of monster you are. Shame on you.

If this is real then you and your nanny are a perfect fit. Not enough morals between the both of you to equal a person I'd want my kid around.

She said she did, though, so I know she's lying. When I asked her how she felt she said "Good. A lot better now because of the medicine." (This was once she was at work--my DH was the one to stay home and wait for her, so he's the one who actually saw her but I called over lunch time) To anyone who thinks I am so unethical or a horrible human being for "invading her privacy" just consider the fact that she made it my business once she lied to me about a fictitious ailment in order to come in to work late, where, once there, she takes over the responsibility of watching MY kids. Besides, what I did was technically not illegal, so unless you are a lawyer in my state or a doctor in my business/hospital, please don't assume otherwise.


No, she didn't make her personal medical information your business whether she lied or not.

It is absolutely illegal, and unethical, and if I didn't think you were a troll I'd be a lot more up in arms about it.

My DB is a doctor and he was reluctant to even ask who my PCP was (we go to the same practice) and kept assuring me I didn't have to answer any of his questions (which were things like, how long did you have to wait, what did you think of the doctor, did you meet so-and-so we did our residency together). I cannot imagine a scenario in which he would think it was appropriate to look into my medical records even if he did have access to them. Ever. At all. Even if I passed out at work and was taken away in an ambulance he wouldn't invade my privacy because 1) it's illegal and 2) it's unethical.

I'm an MB and a doctor and there is no way this could be true. First of all, I would never in 1000 years think of checking my nannies medical record. I would never violate her trust like that but besides that I don't know any ethical doctor out there who would take the chance at doing something so illegal and it IS illegal to do that. You could lose your license over something like that.

It doesn't matter why she was late. She was late. If she has PTO, then you can ask that she take PTO for the time she wasn't at work. If she has no PTO, then she takes the time unpaid.

Her ex SIL was able to see that the nurse had accessed her medical records and filed a complaint with the hospital. Obviously, since this is illegal, it was reported. That former nurse is now in a TON of legal trouble for what she did.

There's no way this is legal. Was she given a controlled substance for a UTI? If not, I don't know what kind of database you're talking about.

OP, tell her that the next time she is late due to a last-minute doctor's appointment, you will need to see a doctor's note or prescription. Let this one go since she is a great nanny and because you also behaved inappropriately by accessing her records. Even if you could, you shouldn't have.

What I'd like to know is, how did you get a hold of ALL this info which clearly concerns your Nanny NOT you so quickly.
It says a LOT about you as an employer, I think you're out of place to go digging in you Nanny's medical record, how would you feel if she did it to you.

you hired her and clearly you DON'T trust her, then I'd say you have bad judgment. Why did you feel the need to go so far, that's illegal. Even as her employer it doesn't give you the RIGHT to violate her rights. You should address the issue of her being late and how often she late and stop sticking your nose where it doesn't belong.

You went into her medical records????!!!! I thought they were strictly confidential. You broke the law in going into them OP and you should be prosecuted for this. Shame on you for abusing your privileges as a Dr.

Ethically what you did was wrong as well and for both you and your nanny's sakes, I would let her go with a nice severance package and an excellent letter of recommendation.

I would never want to work for someone like you. One who abuses her power to break the law.
