Do babies count for use of HOV lanes?

Anonymous
I need to use I-66 which is all HOV inside the beltway during rush hour. I am riding with my 1 month old. Does he count as the second passenger?

From the Virginia gov website:

I'm pregnant. Do I count as one person or two?
In the HOV world, you're one person. However, babies of any age count as a person.

Babies and children who cannot drive count. Virginia just requires you to be person and not an animal.

In order to qualify for use of an HOV lane, you have to be physically able to drive, but not necessarily legally. Thus infants don't count, but advanced toddlers, who could conceivably grasp the wheel, do count.
Chimpanzees count, because they could be trained to drive at least a few feet. Dogs and cats, lacking opposable thumbs, do not.

Regarding infants, that seems to directly contradict the VDOT link in the earlier post. Do you have a source on that?

This is funny. For people who don't realize you are kidding, the direct VA Dept. of Trans. answer is:

Source? What was Moses' source when he found the 10 commandments? What was Aristotle's source when he invented the gyro? What was Joseph Smith's source when he was told about magic underwear etc?

I will take a combination of divine inspiration and rock-solid logic over a "link" to a "website" any day of the week. There are all kinds of nutters on the internet.

My husband was pulled over for using the HOV lane. When the policeman approached, he realized our 1 year old DS was rearfacing in the back seat. DS counted and my husband was not given a ticket.

This person is completely wrong. Infants do count and you will not get a ticket if it's just you and your infant in the car.

The number of people who cannot recognize a joke is just horrifying.
