DP: The fact that the judge asked is what would make him hopeful, if not happy. But it seems Colorado v. Symes, 286 U.S. 510, 520 (1932), answers that pretty clearly. He has to be able to show that "his relation to the transaction growing out of which he has been indicted ... was confined to his acts as an officer.” The transaction for which he was indicted was not confined to his acts as an officer if all but one (whatever that might have been) were not under the color of that duty. In any case, as he conceded all of his activities were political, then by definition and by law, none of them were related to his federal office. Just my quick thoughts. |
It also undermines Trump's "advice of counsel" argument. Eastman seems to be saying that he didn't counsel Trump and Pence to simply reject the electors from PA, AZ, MI, GA, etc. Instead he is saying that he counseled them to "send it back." But Trump tried to get Pence to just reject them so he didn't even follow the crazy advice Eastman was giving him. |
It’s everybody for themselves now. The finger pointing is going to be epic. But at the end of the day, they are a bunch of sniveling whiners and I hope they are beginning to regret the magnitude of their despicable actions. |

Brian Kemp held a press conference today to push back on a recent call for an emergency session of the general assembly to investigate Fulton County District Attorney Fani Willis. Good for him.

Kemp also said that until up to now, he has not seen any evidence that warrants any action by the prosecuting attorneys oversight commission.
