Potomac Yard (Alexandria) HOA — Issues?

Tell us which statements were libelous (presented as factual but were untrue and caused him harm)? His last name wasn’t even mentioned! (Though I know Frank is a very unusual name.). So his libel case will be about as strong as his HOA case. Ha ha.

Good luck with your subpoena.

So people aren’t allowed to criticize lawsuits now? Maybe in TACOland but not in real America. Suing everyone who criticizes you to intimidate them might work for certain powerful people, but good luck to Frank with that lawsuit in a NOVA court.

I guess when you do God's work by helping people, you become a target of the devil. If I bought a home without a driveway or garage, I would not prevent my neighbors from using the common areas.

Based on the posts here, I think the HOA has a better libel case against Frank than the other way around.

You should read the association's pleading then share them on this site.Thete are reasons you are engaging in intrinsic judgement.

I pay for the taxes and upkeep on my garage.

I think it is fair to say that if the case did not have merit, the board would circulate the lawsuit to the entire community. Additionally, an ungaraged townhome owner on Valkenburgh Lane would not have created this blog.

It usually is only one homeowner who sues. Most people don't have the money or time to commit, so they sit on the sidelines and let others fight the battle. Often homeowners in HOAs are completely unaware of their HOA boards are doing with their money, and the boards have a tendancy to spin information or outright lie about what they are allowed to do. Boards also have a tendancy to attack and bully anyone who speaks up or steps out of line. It's easier to keep your in the sand, or at least keep it down, if you live in an HOA.

So I guess this Frank guy is the lone righteous warrior? And everyone else is either a coward or clueless (about their $1.3 million asset)?

Why doesn’t he get on the board? Or is everyone else too cowardly and clueless to vote too?

Sure. Here’s another explanation: he’s just WRONG! And the hundreds of other residents know that the case is nonsense.

It's not about being "a coward or clueless" about their homes. People take care of their homes, but most people are too busy or disinterested to watch what their HOA board is doing and a lot of HOA board members don't read or understand their bylaws. They just go ahead and do what they think is "right" for the community. And sometimes they do things that are legally wrong or violate the bylaws or make unauthorized expenditures. You end up paying for things, like maintaining city property or work on private properties, that is not the HOA's responsibility. Some members don't care about additional unauthorized costs, but some do. It comes down to what was agreed to by the members in the bylaws when they bought their homes.

Thank god for Frank. What would the community do without him? He’s apparently the only resident with the insight, wisdom, foresight, and courage to take on this grave injustice — at great financial and reputational risk. A true hero.

Not a single other resident signed on to this crusade/lawsuit that somehow is ripping everyone off. Will any other residents at least voluntarily testify on his behalf at trial?

He’s doing god’s work, truly. I just hope that at least one other resident eventually sees the light and musters the courage to care about this incredibly important issue.

I am posting to inquire about the common belief among ungaraged townhome owners regarding two "parking spaces." Could you please clarify if this understanding is based on information provided by the HOA or a realtor? I'm trying to understand the source of this assumption, as I am unsure about the reliability of those sources in this context.

It's a question of law for the court, not an opinion vote. Why would other residents need to testify? You seem to misunderstand how the legal system works.

Cool. So I assume it’ll be decided on summary judgment. No trial needed.
