so my sons preschool takes tuition payment 2 months in advance and also requires 2 month notice for withdrawal
the school has been closed since mid march but they still took the march payment which paid for may tutiion. i am considering withdrawig my child immediately and not paying the final tuition payment. My question is in regards to the withdrawal notice. Can they come after me for the final tuition payment since i didnt provide proper notice? Would they be able to send it to collections and affect my credit? I cant imagine that theyd have much of a case in court, as they charged me tuition for services that were not provided. |

You are asking a group of presumably law-abiding people whether they think you can break your contractual obligations and get away with it. You might as well ask "I'm thinking of holding up a 7-Eleven, do you think I can do it and drive off before the cops get there?". The answer in both cases is "Probably yes, if you are the kind of person that would do that." |
I imagine there will be quite a few court cases like this. It is definitely challenging paying for services you're not receiving, especially if there has been a job loss. Hopefully there will be a way to meet in the middle. |
I'm a lawyer. You're fine. The contract has already not been fulfilled. Walk away. Don't pay. If they come after you, blast them on every website you can and give them bad reviews, report them to the county, make random allegations to the licensing department and let them fight for their reputation. Don't make false allegations but file a complaint with BBB and County Consumer Affairs and other places. They have not been providing services so I'd consider that the two month termination. |
They will pay more in attorney fees than they can recoup in payments. |
They terminated the contract as they can no longer pay the service that OP is paying for. |
