I am the OP of the "And so it begins" thread where my ASD/ ADHD kiddo was basically swarmed by strangers during a meltdown and pinned to the floor by the plant engineer. His crisis plan in his IEP where he was to be offered a FastPass to a safe spot was not implemented. ANd the team engaged in behavior that had been specifically noted as escalating in his IEP (unknown people, multiple extra observers, sensory issues with wet pants). Plus the hold that they used had him lying on his back with his legs pinned under someone's legs with another person keeping their hands on his legs under the pinning legs.

THe CPI trained responders on that thread basically said that none of what happened is an appropriate hold. http://www.dcurbanmom.com/jforum/posts/list/752349.page The school refuses to include their own actions in the documentation of crisis management form. And they are now saying that no other parent has ever asked to see this form, so they don't have to complete it accurately. So I know I need to make a state complaint. On our state form we have to provide specific information about how the state or subgrantee has violated a requirement of a federal statute or regulation that concerns a covered program. Several PPs on the other threads have suggested that there may be violations of FERPA or IDEA. Is one better than the other? Should I include both? Thanks for any guidance you can provide! |
