The piece you are missing is that even if Florida were to jump through the 5,327 hoops that would be required to follow through on dissolving Reedy Creek but sticking Disney with the debt obligation, it ultimately would have to survive a First Amendment challenge to SCOTUS. And if Florida actually goes through all 5,327 hoops, it will create undeniable evidence that Disney was targeted specifically based on it's exercise of its right to free speech. SCOTUS would not be able to uphold what Florida is trying to do without overturning Citizens United, and there is no way SCOTUS will do that. Because the bigger piece you are missing is that even the most loyal right-wing SCOTUS justices are not loyal to DeSantis or the Florida GOP, they are loyal to the national party and FedSoc, neither of which want to touch this with a 10-foot pole. I mean, no one who matters outside of Florida is speaking up to back DeSantis on this, because they know what it would take to uphold it, and it is very much not in the interest of the Republican National Committee or the Federalist Society to allow that to happen. And when Trump has to face DeSantis in the 2024 primary, he will shred DeSantis over it too, which will give everyone else free license to attack DeSantis as well. Even if he wins re-election in Florida this year, he may very well have tanked his prospects for the presidency in 2024. |
