Me again. I must add that STD happens in tandem with FMLA, HOWEVER, for the amount of time that you arre healing MEDICALLY, that goes toward your 16 weeks of medical leave. After that you can use your 16 weeks of family leave.

Thank you for posting, OP. Good to know. I've always thought the federal provisions for maternity were surprisingly archaic. I now know at least the D.C. laws are better for pregnant women

OP here. This was four years ago. I just keep bumping it because people are always to grateful when it reappears. I was lucky to work in DC at the time. Now I work form VA but in a whole different situation and I'm done having babies now.

Does anyone know what the situation is if I work from home in DC for a company based out of the DC area (now MD or VA)? My employer takes out DC taxes.

ok... first, may I be the 100th person to say THANK YOU. My DC-based, all-male led non-profit's personnel manual says only 12. So I will be raising this. But I'm a little confused about something... do you get 6 weeks of medical leave for a vaginal birth (or 8 for C-sec) PLUS 16 weeks for family leave? I've read the answers on this and people say they happen "in tandem," but I'm sorry I don't understand what that means. I get if you are diagnose with something irregular either pre or post birth, you have up to 16 weeks for medical leave. But let's say in the "normal" circumstance... do you get 16 plus 6/8 or just the 16? THANKS!

Yes. I had a vaginal birth and had 6 weeks medical leave, because that's when my dr said I could return to work. Then I got an additional 16 weeks of baby bonding time. 22 weeks total, which could be taken over the 9 months after the baby was born.

If you qualify for DC FMLA medical leave and family do not run concurrently. So yes, you may generally take 6 weeks for recovery from vaginal birth (8 for c-section) before starting your 16 weeks of family leave. (This differs from federal FMLA where they do run concurrently)

1607.1 The entitlement to sixteen (16) weeks of family leave during any twenty- four (24)-month period shall be separate from and in addition to the entitlement to sixteen (16) weeks of medical leave during any twenty-four (24)-month period. This means that an eligible employee may take both up to sixteen (16) weeks of medical leave and up to sixteen (16) weeks of family leave during the same twenty-four (24)-month period, notwithstanding 29 CFR ยง 825.701(a)(1).

I have had to "correct" HR on the entitlements under DC FMLA for both my pregnancies (small organization and staff had turned over). Do not assume that your HR department knows what you are entitled to.

Yes, the 6 or 8 weeks leave (for vaginal or c-sec) would come out of the allowable 16 weeks for short term disability.

FMLA, is another separate 16 weeks. So you can heal and then start your maternity leave.
