Both kids are from MoCo (Potomac and Bethesda). MoCo law explicitly defines air guns as firearms. Depending on size (the standard is whether it’s concealable on one’s person), an air gun may also be classified as a handgun under MoCo law. Doesn’t look like you’re even allowed to shoot one for sport (vs. e.g. killing a dangerous animal) in the urbanized areas of the county unless you’re in a basement or at a licensed shooting range. And you can’t legally transport such a gun within 100 yards of a place of public assembly (including a school) unless it’s unloaded and stored in an enclosed case or locked rack. So I think they were violating the laws of their own jurisdiction as well. It's not just a case where DC has unusually restrictive standards.

I can't believe it took so long for someone to take that bait! Anybody who can't see the difference between kids playing with plastic guns and killing people (or animals) has some judgment issues. Are you the parent who flipped out a while back when somebody gave her son a marshmallow shooter for a present? Lighten up. And yes, I'll take any recreational activity that gets my kids outside, particularly in nature, enjoying themselves with other kids. I'll admit I was reluctant at first, because I associate guns with rednecks (my own bias) -- and I'll object strongly if they ever want to hunt (I've been a vegetarian most of my life -- how's that for pro-life?). But I am so much against my kids sitting inside by themselves in front of computer/tv screens in their free time that I relented on the airsoft guns.

Was this BB gun loaded? Not available info. Was it in a proper case for transport? How many yards could it shoot? Bring it to a FCPS school and what would happen?
