Anyone successfully sued pot head neighbors?

We can’t even get our neighbors arrested when we sent the police videos of them selling drugs right in front of their house.

Neighbors can smoke, but there should be a limit to ensure adjacent neighbors can use their property too. Smokers should get fans to help disperse the smoke and do their best to ensure the smoke is not concentrated beyond their property line.

If you start off your relationship by taking this stance, I pity your neighbors. You need to be considerate to those around you. Telling them that it is not your problem that your dope addiction is affecting their lives is pretty selfish.

Anyway, What goes around comes around. strong believer in that.

Your response here is confusing. Did you read PP's comment? She was advocating for being a considerate neighbor.

Maybe (though I don't really see why that'd be a good use of public resources), but in this case, OP is talking about neighbors smoking on private property, which is legal.

I think there's a high bar to prove a smoking nuisance. There was a lawsuit a few years ago in Greenbelt where a neighbor (shared wall) sued because the HOA wouldn't stop their neighbor from smoking outside. The court basically said that the neighbor going outside a few times a day wasn't a nuisance and that the complainer should close their windows/get a fan.

I think there's a big difference between someone who goes out to smoke a few times a day vs. literally chain smoking up a storm all day every day. The former I could deal with. The latter I couldn't tolerate. This is city living. You're going to have neighbors who live life differently than you do. As long as their habits don't prevent you from reasonably living your life, then live and let live. And someone going outside a few times a day to smoke isn't going to ruin your life or health.

I don't know. You are smoking a drug. In the case of cigarettes it causes cancer. You should not have to go inside and close up all your windows because your neighbor decides he wants to get high in his house or outside. That is preventing that person from enjoying his property. Why should you have to change your habits because your neighbor is inconsiderate or does things that inversely affects their lifestyle?

Let's see, if the smoke penetrated your walls, paint, furniture, items costing you thousands to replace, you can sue them for that.

Exactly. Because society has decided that we are still going to yield to smokers' right to smoke in a way that pollutes everyone else's air. We all know about second hand smoke; we all know about carcinogens found in second hand smoke. And yet in 2021, we still yield to the smokers who subject people to their cancer causing air in multifamily housing, etc. It's not just unpleasant or a smelly nuisance- what they're doing causes real harm. If you want to talk about freedom, you need to talk about my freedom to have good air in my home- not the smoker's right to pollute it.

When my neighbor smokes, I do something crazy: I close my window for 5 minutes (if it's open). Problem solved! It's a pretty easy problem to solve. I do the same when there are kids outside being young, people playing music, dogs barking, etc.

Close a window and the smoke goes away... if only it were that easy in multi family housing where air so easily passes from one unit to the next.

Then why isn’t anyone over 40 dead? Most people that age or older grew up in a world with smoking literally everywhere. I’m not condoning smoking but some people act like they are going to die if they get a whiff of outdoor smoke which isn’t going to happen.

My school bus driver smoked everyday during the ride to and from school.
