Pro-tip - you cannot rear-end someone if you leave adequate following distance and pay attention - no matter HOW hard they hit their brakes! They could come to a screeching halt in front of you, and you'd STILL be able to stop in time, IF you weren't tailgating them.

This. Or any number of "reasons", real or made up, will excuse the brake tap. Sorry, it just will. The Dashcam will only show that you were following too close. It likely will not reflect the reason (dear, squirrel, etc.) that the person hit the brakes. The cops will cite the follower. I"m not excusing it or advocating it. And I've certainly not done it, but you are kidding yourself if you think anyone other than the tail gate will be cited here.

There is no getting out of it. It's your responsibility *not* to hit the car in front of you, no matter what they do. No amount of dashcam video or excuses or accusations on your part is going to negate the fact that you failed to keep from hitting the car in front of you. One person is going to be charged for that crash - you. The easiest way to prevent it is to not tailgate. It's crazy that there are so many people on this thread who think they have a devine right to tailgate and be immune from the liability that comes with. Absolutely crazy.

I don't break check people, because I don't feel like getting hit, regardless of whose fault it is. However, the other day someone was tailgating me on Foxhall Road, and I just . . . slowed down. Gradually. I started off doing 5 mph over, then got to the speed limit. When he still didn't back off, I slowed down even more. Then, I intentionally waited to make it through the light so he wouldn't make it.

There is literally no speed slow enough that I won't coast down to to get you to go around me. I mean, if you're willing to drive 24" from my rear bumper at 35 mph down Foxhall, then passing me on a double yellow certainly isn't a stretch for you. Go around. Be a jerk to someone else.
