How are you going to even prove this? They will judge the applicants on the strength of their essays. |
Everything is digital now. Far easier to do now than it ever was…. |

Its all a bunch of Matt yglesias and alejandro mayorkas ie ashkenazis with a tinge of latino
|
It's giving preference to one's lived racial experience, regardless of race. That's still a racial preference. |
NP. Naw. In this example, the preference is given to an individual that demonstrated the ability overcome external forces working against them. In this case negative opinions of their race was the reason for the external forces against them. It's not a racial preference. It's a preference for the demonstration of grit, determination, etc. shown |
| It's not either or. Admissions offices are giving weight to both grit/determination and to a personal experience that wouldn't be possible without specific racial identity. |
Exactly. |
DP. Not everything is written. And not everything is written digitally, specifically due to the possibility of electronic discovery. Times are changing indeed. |
No, people can have other forces that work against them through which they exhibit grit/determination that is part of their lived experience. If I student overdose cancer, is that a preference for cancer sufferers. Or a student that overcomes an abusive home - preference for abused students? The interest in the student is what did they learn, how did they grow, how has it impacted thier perspective, etc. |
If there is a statistically significant difference between the URM kids who revealed their race in their applications and they did significantly better than applicants (with the same objective criteria) who didn't, then you might be able to develop a case. There are so many ways to uncover bias, this is not the bottleneck. |
PP here. Not under SFFA, it isn't. You have always been allowed to write about your personal experiences and nothing in the opinion says you cannot continue to write about them. The school is not allowed to value black stories above white stories but you can write essays about race. |
Failure to document the deliberation process with a resulting inexplicable racial disparity is not going to help a school's case. |
Yes. But in this scenario we are saying Dartmouth is full of Latinas who are actually White. I.e. Have recent European heritage. So this still benefits White students, not the Latinas you truly need the boost |
Who bears the burden of proof? How does the plaintiff prove the racial disparity is inexplicable? |
Everything is written digitally: they are called college essays. |
