Groomer injured my dog!

Long story short...the Groomer cut my dog's leg so bad we had 3 vet visits and ultimately surgery to repair the leg for a total cost of $750. I have submitted the bills via email and called and left a message confirming receipt with no response. Going to call again to confirm receipt of the bills. How long should I expect to wait for payment before taking it to small claims court?

You left out the part where the groomer accepted responsibility and agreed to pay the bill, I think. Did that happen.

Isn't there some sort of express or implied consent -- animals are animals and sometimes get injuries, and unless the injury is intentional, it's accepted by the owner?

Did you sign a waiver? Is the Groomer an established shop or someone on their own?

I think I did years ago when I first became a client but that was before with a different groomer in a different location, under a different name and under different ownership. The woman who now owns and grooms the animals was not in the picture when/if I signed the waiver. The original owner had the business under a different name and then joined forces with a larger salon in the area then a new person took ownership and my groomer left. And now here we are!

The groomer agreed to pay the first bill until she realized that my dog would need surgery and then started back pedalling about taking responsibility.

Yes, I think to a point, minor nicks or cuts are fine and understable but when it's so bad that it requires surgery to repair a grooming injury, I belive that goes beyond implied consent. It cost us $750 to fix this groomers mistake...wouldn't you want to be reimbursed if it were your dog? This is why they have insurance, right?

I would not accept this kind of injury. If they did not pay the bill, they would see me in court.

I believe that the dog owner consents to the "animals are animals" type of injuries -- something like a miscut of a toenail or a bad haircut or the like. Dog owner does not consent to negligence -- which it appears this was.

If they are a business then they will have insurance to pay your vet bill. FedEx everything again and get a direct signature for proof of receipt...you might have to send your bills by certified mail with "return receipt requested".

You may need to go to court if you want a full refund. Your quickest and cheapest route is to work out an agreement with the groomer. Visit in person, see if she'll pay at least half the bill. Threaten to post bad reviews online. Those would probably cost her more money than the few hundred she owes you.

Omg!!! Poor dog. Please tell us what groomer. I will never take mine there! Post a Yelp review as well.

This is most likely an accident. I have a tiny yorkie that darts around. Even if they cut him, I'd think - HEY you shouldn't have moved. Going to yelp and posting something like this is dumb. Do you realize all groomers have accidents right? Figure they groom 10-30 dogs a day and Injure one a month or two or six months.
