Official Brett Kavanaugh Thread, Part 3

Cruz: "How do you handle conflicting testimony? You look at what the rest of the evidence demonstrates."

But he won't support an FBI investigation

He could've said, "Those yearbook entries...I wanted people to think I was cool. I was 17 and it was immature to put those quotes in my yearbook. I realize how it looks, but that's not the kind of person I was then. I think my reputation as an adult and as a judge is more reflective of who I am than how I acted in high school."

Had he said those things, he could've seemed relatable, humble, professional and respectable. But he didn't say anything close to that. Instead, he went off on partisan rant, got defensive, was evasive in answering questions and confirmed for a lot people that he seems exactly like the type of person who could sexually assault a girl.

Exactly. It's this. He got angry, and lied about stupid s***, which undermines his overall credibility.

+1! This is exactly what he should have done, and then this whole issue would have gone away. I think almost everyone did something in the past that they are not proud of, whether it be drink too much, bully someone, tell lies, etc. And then we grow up and realize we were wrong. Admitting as much makes you a responsible adult. Denying it makes you look like you have even more to hide.

This is it!! It's why I hammer that message home to my children. Everyone makes mistakes, everyone. What you do after you've made that mistake is the proof of your character.

Sheldon Whitehouse (D) just made an excellent recap to the committee:

""I may be wrong, but I believed her... And I believe Kavanaugh dodged and dissembled, ranted and raved, filibustered and prevaricated. I did not find him credible... I don't believe 'The Devil's Triangle' is a drinking game, and I don't believe calling yourself a girl's 'alumnus' is being her friend. And I think drinking until you 'ralph' or fall out of the bus or don't remember the game or need to piece together your memory the next day is more consistent with Dr. Ford's and others' testimony than his own. "

I've never seen Sheldon Whitehouse before, but, as a lawyer, I was impressed with him yesterday. I bet he was a great lawyer. Very calm, clear questions, focused and didn't lose the question when the witness tried to wiggle. Unfortunately, the stupid 5 minute format made it impossible for him to complete his examination. It was really not a good system for uncovering the truth, and most of the R's just wasted time with their speechifying. (I thought Corey Booker also wasted his time.) Would have been a much more effective hearing if they'd split it into 1/2 hour segments and gave each side 1/2 hour, then flipped, and if the Rs had used the AZ prosecutor for all their questions, and the Ds had used some combination of Whitehouse, Harris and Klorbuchar, all of whom are talented trial attorneys who also come across as decent human beings. (Yes, I know that the Rs are calling Whitehouse a sleeze for asking the yearbook questions, but it had to be done, and it was good of him to take that one for the team.)

I was incredibly impressed with the list of questions Whitehouse asked after the first round of hearings. There were a bunch of financial expenses and tracking of debts and balance sheets and it was a pretty thorough line of questioning. Whitehouse should consider running

Probably as it looks like he’s voting him out of Committee. Party over country once again.

He all but said so yesterday. He basically preemptively apologized.

Pulling a McCain ? Vote out of committe and then vote no on the final vote ?

He does not have the spine to do it.

For Republicans - why wasn’t it a good idea to withdraw this guy and put up someone else with similar legal experience and opinions? I don’t understand. You can get your majority on the Supreme Court - what is so special about this particular candidate?

I agree -- Whitehouse getting him to lie about small things really made him look bad.

Also, Booker didn't waste his time - he got him to agree that he drinks on weeknights, which opens many more days on his calendar as possible nights that this happened, including the "skis" night that many people have pointed to.

Anonymous wrote:I don't think he assaulted Ford. There a couple of reasons why:

1. The friend that she went to the party with does not support her story. If things happened the way that she said they did, her friend would have remembered that night. She left the party without talking to her friend. That friend would have been angry. Two girls at a house with 4 boys and one of them leaves without telling the other? That friend would have called her the next day asking what the heck happened. Also what kind of friend gets assaulted by two guys and leaves her friend in the house with the same two guys???

2. Her family is not supporting her. That is very telling.

+1

I am no fan of Kavanaugh, BUT so many questions!

Strongest memory was laughter, not face of attacker - how is she so sure it was Kavanaugh?

Implored FBI to determine employment history of Mark Judge, when her lawyers presumably had access to Judge's book.

Who drove her home? She didn't have a car/license and Leland presumably did not either, given that they were in the same grade. That would mean that a boy drove her home. Could not have been Mark or Brett - that leaves PJ or boy whose name she doesn't remember.

She testified that she ran out of the house, passing the kids in the living room -- what happened after she ran outside? How did she get someone to drive her home?

Also, what about Squi, whom she was dating? When did they stop dating? Where was he that night?

Her family supported her. Did they expose themselves? No. Neither did Brett’s parents. Why should they?
When reports called the Blasey parent household the dad answered to say that he ‘loved and supported his daughter’. That’s enough.

I certainly don’t think this pertains to guilt or innocence but his parents were there in the first row behind him yesterday.

Can someone PLEASE post the Leland letter? I want to know if the R's are lying about it.

DCUM DCUM. Dude, my kids' K-12 had deeper discussions on the trial than this garbage. Grow up.

Ford and Kav's lives will be upside down from this point onward, regardless of where they are working or living. Same for their kids' lives. Total mess. And I blame Feinstein - bad timing, bad move.

He will vote to protect Trump in upcoming case:

That's why I think Senator Graham lost his cool. He will probably go down if Trump goes down.

Kavanaugh will vote to save them all. Otherwise it will be a 4-4 decision.

+1 If he were innocent he would have welcomed an investigation. There's a lot of people in Chevy Chase who won't feel comfortable having him around their kids anymore.

People in Chevy Chase are the most shallow folks I have met. They will absolutely have their children around s SCJ, even if he has a history of sexual assault.

You probably haven't met many people. And I'm from Chevy Chase, and people have been talking about how we won't be able to coach kids' sports anymore.

I live in Chevy Chase and know the Kavanaughs and others in attendance yesterday. They aren’t losing friends. There are plenty of social climbers willing to set aside morals and ethics to be associated with them. Trust me.

I assumed that people over there volunteer to coach not because they are really interested but to appear like good people and for social climbing reasons.
I’m a pillar of the community because I coach girls basketball (where my daughter is always a starter!!).

Was he trying to look like Merrick Garland? Who has tutored city kids for 20+ years?

That’s a pretty low blow. Men mature. Even the ones who were raised to be entitled jerks usually mature.
Also, most everyone else’s husband in that area has been prone to fits of temper I’m sure.

Am an independent, but my take is that would have been suicidal for the Republicans in terms of the midterms because it would have alienated its base, which would have been turned off by what they would have viewed as a show of weakness.

I assume that was Feinstein's tactic: Make the hearing so ugly at the last minute that there is NO TIME to put up someone else without stalling the process/vote until after the Midterms.

It does not get uglier than this. Two political ploys just ruined their lives up on national TV yesterday.
